Reasons: (1) The structure of this particular organization is quite unique. The wording is not clearly fatal to qualification as an NPO in these circumstances and not only was any questionable wording changed, it was never acted upon. The ultimate determination would have to be made by Compliance Programs Branch.
(2) The proposed activity is a means for the NPO to pursue its objects
(3) The application of section 159 depends on many factors, which determinations are outside of this Directorate's knowledge or mandate. If, at any time, the Organization violated the NPO rules, and thereby became taxable, section 159 may have application.

Principal Issues: If a person learns he or she is entitled to be registered as an Indian can a tax exemption be claimed for income situated on a reserve in years prior to applying for registration?

Position: Yes

Reasons: Section 87 of the Indian Act provides an exemption for the personal property of an Indian where that property is situated on a reserve. The term Indian is defined to be a person registered as an Indian or entitled to be so registered. It is the date upon which the entitlement arose which determines when an individual is eligible for the tax exemption in section 87.
If the individual can demonstrate that in a particular year he or she was entitled to be registered as an Indian and earned income that was situated on a reserve, the CRA can reassess and issue a refund of tax within three years of the original assessment, or, as part of the Fairness Package, can do so for a period of ten calendar years prior to the request.

Rental income from an immovable rental property located in the province of Quebec, earned by a corporation (otherwise than in the carrying on a business in Canada), which is tax in Canada pursuant to section 216 is not a taxable income earned in the year in a province for the purpose of subsection 124(1) and does not entitle the corporation to the tax deduction provided for in that subsection. Pursuant to Taxation Act of Quebec, this rental income is taxable in Quebec. Does the CRA intend to adopt an administrative position to give a tax relief to the corporation by allowing the tax deduction provided for in subsection 124(1)?

Paragraph 3(1)(f) of the Copyright Act provides that a copyright includes, amongst other things, the sole right to communicate to the public, by telecommunication, any literary, dramatic, musical or artistic work. This right is distinct from the right to produce or reproduce the work. If the corporation acquired the right to use the right provided for in paragraph 3(1)(f) of the Copyright Act, the amounts paid by the corporation would be payments to which subparagraph 212(1)(d)(i) woul apply. Subparagraph 212(1)(d)(vi) would not apply as the right acquired is distinct from the right to produce or reproduce. The amounts paid would constitute a royalty for the purpose of Article XII of the Convention.
