CCA can be claimed on asset made available to employee-shareholder qua employee

21 March 2012 External T.I. 2011-0423141E5 F - Application du paragraphe 107(4.1)

s. 107(4.1) applied to distribution to settlor/beneficiary of property acquired with borrowed money

Unedited CRA Tags
9(1), 18(1)a), 18(1)b).
commissions paid for leasing-up a new building generally are fully and currently deductible

20 March 2012 External T.I. 2012-0433121E5 - Municipal Officers' expense allowance

Unedited CRA Tags
6(1)(a), 6(1)(b), 81(3)

Principal Issues: What is the proper tax treatment relating to payments made to an elected municipal officer from a Discretionary Fund?

Position: Question of fact.

Reasons: Proper treatment of a payment depends on whether a receipt is required (i.e accountable vs non-accountable) and whether the expense is considered primarily for the benefit of the officer or the employer (i.e. personal vs municipal business).

disposition of partnership interest for nil proceeds when partnership dissolved upon winding-up distribution
disposition of partnership interest even though no proceeds received

12 March 2012 External T.I. 2011-0425361E5 F - Assistance paid by franchisor

Unedited CRA Tags
9(1); 12(1)(x); 52(4)
reimbursements of business expenses increase income
contest awards paid to franchisees includible under s. 12(1)(x) if not under s. 9

Principales Questions: Franchisees would submit an application to have a chance to receive an amount of money from their franchisor. That amount would have to be used for a specified purpose. Other conditions would have to be fulfilled by the franchisee to receive the amount. What are the tax consequences with respect to the amount earned for the franchisee chosen to receive that amount?

Position Adoptée: In such a situation, subsection 52(4) of the Act would not apply. General comments on subsection 9(1) and paragraph 12(1)(x) of the Act.

Raisons: The event organized by the franchisor would not be considered as being a lottery for the reasons below. The amount would be received by the franchisee in the course of carrying on its business. An analysis of all the relevant facts would be required to reach a definitive conclusion with respect to the specific tax consequences in a particular situation.

land that had been farmed for 5 years before being rented out to neighbouring farmer qualified, including farm house

Unedited CRA Tags
149(1)l)
articles of NPO should have prohibition on profit-seeking by it and any successor
