Principal Issues: The income tax treatment of automobiles purchased by employees from a lessor where the particular automobiles were previously leased by the employer.

Position: An employee benefit, equal to the excess of the automobile's fair market value over the purchase price paid by the employee for the automobile, will be considered to have been received by the employee. We will also accept that for the purposes of determining the employee's standby-charge that the employer has effectively received a "terminal credit" in respect of that leased automobile equal to the amount of the employment benefit.

Reasons: In this situation, the employee's right to purchase the leased automobile arose directly from the employee's employment with the employer.

Principal Issues: Whether moving expenses paid for by the former employer and then later repaid by an individual pursuant to a termination agreement are eligible for the deduction under subsection 62(1) of the Act.

Position: Yes, the payment is deductible in the year paid against income from the new work location earned in the year of payment, and as long as all of the conditions of subsection 62(1) are met. The expenses may not be carried back to a previous year.

Reasons: Pursuant to subsection 62(1), eligible moving expenses paid by the taxpayer in a year subsequent to an eligible relocation may be claimed in the year in which they are paid.

Position Adoptée: Question de fait. L'allocation de repas versée à un employé col bleu avant ou après les XXXXXXXXXX premières heures de travail continu en surtemps ne serait pas imposable car elle respecterait tous les critères de la politique administrative de l'Agence du revenu du Canada quant aux repas et allocations fournis aux employés pendant les heures supplémentaires énoncée aux Nouvelles techniques No 40. Puisque l'allocation de repas versée à un employé col bleu est versée indépendamment du fait qu'un employé doit prendre un repas, c'est-à dire qu'elle ne s'appuie pas sur le fait qu'un employé doit prendre un repas, l'allocation versée après les XXXXXXXXXX heures supplémentaires, suivant les heures normales de travail et les XXXXXXXXXX premières heures de travail continu en surtemps, prendrait la forme d'une rémunération additionnelle et serait imposable pour l'employé col bleu. L'allocation de repas versée à un pompier à temps partiel qui répond à un appel d'urgence ne respecte pas les critères de la politique administrative et serait imposable.

Raisons: Application de l'alinéa 6(1)a) et de la politique administrative quant aux repas pendant le temps supplémentaire énoncée aux Nouvelle techniques No 40.

Principal Issues: Under what circumstances do trusts have to make tax instalments?

Position: 1. Trusts are taxed as individuals and may be required to make instalment payments if conditions in s. 156 of the Act are met. Inter vivos trusts may be required to make quarterly instalment payments if the inter vivos trust's net tax owing is more than $3,000 in 2010 and in either 2009 or 2008. However, under the current CRA policy, no assessments are made on instalment interest and penalties where an inter vivos trust does not make instalment payments. 2. Testamentary trusts are not required to make quarterly instalment payments and are allowed instead to pay their tax payable for the year within 90 days from the end of the taxation year.

Principal Issues: An interest in a life insurance policy is transferred from a non-arm's length person to a donor and subsequently gifted to a qualified donee. Where the gift is subject to proposed subparagraph 248(35)(b)(i) or (ii) and proposed subsection 248(36), what is the deemed FMV of the gift?

Position: The deemed FMV of the gift will be determined based on the lesser of the cost of the interest in the life insurance policy to the donor and the cost of the interest in the policy to the non-arm's length person immediately before the interest in the policy was disposed of by that person. It is the CRA's view that the ACB of an interest in a life insurance policy is generally a reasonable proxy for the "cost" of an interest in a policy. Where subsection 148(7) has applied to deem the cost of an interest in a policy to be the value of the interest in the policy, this adjustment will be relevant in the determination of the ACB of the interest in the policy and the fair market value of a gift pursuant to proposed subparagraph 248(35)(b)(i) or (ii).
