Position: No

Reasons: The wording of the Act does not contain this restriction. The place where the vehicle is used must be a special work site or a remote location referred to in subparagraph 6(6)(a)(i) or (ii) of the Act for one of the vehicle's occupants.

Request for an opinion on the definition of automobile

This is in response to your email of August 18, 2004 in which you requested our opinion on the above subject. We apologize for the delay in responding to your request.

FACTS

A taxpayer is an employee of a logging contractor and is required to work at logging sites that are special work sites or remote locations described in subparagraph 6(6)(a)(i) or (ii) of the Income Tax Act (the "Act").

The taxpayer also carries on a business in which he holds, inter alia, a harvester and a pick-up truck that he purchased for $45,000 before taxes. The taxpayer's business leases the harvester to the logging contractor. The vehicle is used primarily by the taxpayer's business to transport equipment and maintenance parts for the harvester. The taxpayer's business does not have any employees; and it is the taxpayer who drives the vehicle in transporting equipment and maintenance parts when working at the harvesting sites.

QUESTIONS

You would like our opinion as to whether the capital cost of the vehicle will be limited to the amount prescribed under paragraph 13(7)(g). In particular, you wish to know whether the vehicle falls within the new exception in subparagraph (d)(iii) of the definition of automobile in subsection 248(1).

You would also like our opinion as to whether section 67.3 would apply to the vehicle if the taxpayer's business had leased the vehicle instead of purchasing it.

YOUR POSITION

To be excluded from the definition of automobile pursuant to subparagraph (e)(iii) of that definition in subsection 248(1), you are of the view that the "occupant" in clause (e)(iii)(A) of that definition must be an employee of the business that owns the vehicle.

Since the taxpayer is an employee of the logging contractor and not an employee of the individual’s business, you are of the view that the vehicle does not fall within the exception in subparagraph (d)(iii) of the definition of "automobile" in subsection 248(1), so that the vehicle would be an automobile for purposes of the Act and its capital cost would be limited by paragraph 13(7)(g).

OUR COMMENTS

To be excluded from the definition of automobile in subsection 248(1) under subparagraph (e)(iii) of that definition, the pick-up truck type vehicle must be used, in the taxation year in which it is acquired or leased, primarily for the transportation of goods, equipment or passengers in the course of earning or producing income at one or more locations in Canada that are, in respect of any of the occupants of the vehicle, described in subparagraph 6(6)(a)(i) or (ii).

In order to meet the condition set out in clause (e)(iii)(A) of the definition of automobile, we are of the view that it is the place where the vehicle is used that must be a special work site or remote location as defined by subparagraph 6(6)(a)(i) or (ii). Although reference to one or more of the occupants of the vehicle is necessary for the concept of special work site or remote location to be applicable, we do not agree that the occupant must be an employee of the company that owns the vehicle for the location to be covered by subparagraphs 6(6)(a)(i) or (ii). It is our view that such a condition is not found in the wording of clause (e)(iii)(A) of the definition of automobile and that this clause is broader in scope.

We are of the view that the wording of the exclusion in subparagraph (e)(iii) of the definition of automobile should be broad enough to allow, inter alia, an employee's own vehicle that is used in the course of employment under the conditions set out in that subparagraph, and for which the employee's expenses are not reimbursed by the employee's employer, to be excluded from the definition of automobile for the purpose of computing the employee's employment expenses. We are also of the view that the exception in subparagraph (e)(iii) of the definition of automobile may even apply to a self-employed person who primarily uses the individual’s vehicle at a location described in subparagraphs 6(6)(a)(i) or (ii), as in the situation you have submitted.

In the situation presented, we are of the view that, if all the other conditions set out in subparagraph (e)(iii) of the definition of automobile in subsection 248(1) are satisfied, the vehicle held by the taxpayer's business would not be an automobile for purposes of the Act even though the taxpayer's business has no employees, since one or more of the locations where the vehicle is used is described in subparagraph 6(6)(a)(i) or (ii) with respect to the taxpayer who drives the vehicle

It should be noted that the question of whether a vehicle is used for business or personal purposes is a question of fact that will have to be analyzed before allowing deductions relating to the vehicle in computing the taxpayer's business income. For this purpose, we refer you to, inter alia, opinion 2001-007075A on the travel of forestry workers.

As for the situation where the taxpayer's business leases the vehicle instead of purchasing it, our conclusions are the same since section 67.3 applies to a vehicle that is a passenger vehicle, and therefore applies, inter alia, the definition of automobile in subsection 248(1). In this situation, if the exception provided for in subparagraph (e)(iii) of the definition of automobile applies, the vehicle would not be an automobile or a passenger vehicle, and therefore section 67.3 would not apply.

For your information, unless exempted, a copy of this memorandum will be severed using the Access to Information Act criteria and placed in the Canada Revenue Agency's electronic library. A severed copy will also be distributed to the commercial tax publishers for inclusion in their databases. The severing process will remove all material that is not subject to disclosure, including information that could disclose the identity of the taxpayer. Demande d'opinion concernant la définition d'automobile

La présente est en réponse à votre courriel du 18 août 2004 par lequel vous désirez connaître notre opinion concernant le sujet mentionné en titre. Nous nous excusons du délai requis pour répondre à votre demande.

FAITS

Un contribuable est employé d'un entrepreneur en charge de la coupe de bois et il doit se rendre travailler sur des sites de coupes en forêt qui sont pour lui des chantiers particuliers ou des endroits éloignés visés aux sous-alinéas 6(6)a)(i) ou (ii) de la Loi de l'impôt sur le revenu (ci-après, la " Loi ").

Le contribuable exploite également une entreprise dans laquelle il possède, entre autres, une abatteuse et un véhicule de type camionnette qu'il a acheté au coût de 45 000 $ avant les taxes. L'entreprise du contribuable loue l'abatteuse à l'entrepreneur en charge de la coupe de bois. Le véhicule est utilisé principalement par l'entreprise du contribuable pour le transport de matériel et de pièces d'entretien pour l'abatteuse. L'entreprise du contribuable n'a pas d'employé, c'est le contribuable qui conduit le véhicule pour le transport du matériel et des pièces d'entretien lorsqu'il se rend travailler sur les sites de coupes.

QUESTIONS

Vous aimeriez obtenir notre opinion à savoir si le coût en capital du véhicule sera limité au montant prescrit en vertu de l'alinéa 13(7)g) de la Loi. Plus particulièrement, vous aimeriez savoir si le véhicule est visé par la nouvelle exception prévue au sous-alinéa d)(iii) de la définition d'automobile au paragraphe 248(1) de la Loi.

Vous aimeriez également avoir notre opinion à savoir si l'article 67.3 de la Loi s'appliquerait au véhicule dans le cas où l'entreprise du contribuable aurait loué le véhicule au lieu de l'acheter.

VOTRE POSITION

Pour être exclus de la définition d'automobile en vertu du sous-alinéa d)(iii) de cette définition au paragraphe 248(1) de la Loi, vous êtes d'avis que l'" occupant ", prévu à la division d)(iii)(A) de cette définition, doit être un employé de l'entreprise qui possède le véhicule.

Puisque le contribuable est employé de l'entrepreneur en charge de la coupe et non un employé de son entreprise, vous êtes d'avis que le véhicule n'est pas visé par l'exception prévue au sous-alinéa d)(iii) de la définition d'automobile au paragraphe 248(1) de la Loi de telle sorte que le véhicule serait une automobile aux fins de la Loi et que son coût en capital serait restreint par l'alinéa 13(7)g) de la Loi.

NOS COMMENTAIRES

Pour être exclus de la définition d'automobile au paragraphe 248(1) de la Loi selon le sous-alinéa d)(iii) de cette définition, le véhicule de type camionnette doit être utilisé, au cours de l'année d'imposition où il a été acquis ou loué, principalement pour le transport de marchandise, de matériel ou de passagers en vue de gagner un revenu à un ou plusieurs endroits au Canada qui sont, entre autres, visés, pour ce qui est d'un ou de plusieurs des occupants du véhicule, aux sous-alinéas 6(6)a)(i) ou (ii) de la Loi.

Pour rencontrer la condition prévue à la division d)(iii)(A) de la définition d'automobile, nous sommes d'avis que c'est l'endroit où est utilisé le véhicule qui doit être un chantier particulier ou un endroit éloigné tel que défini par les sous-alinéas 6(6)a)(i) ou (ii) de la Loi. Bien que la référence à un ou plusieurs des occupants du véhicule est nécessaire pour que la notion de chantier particulier ou d'endroit éloigné soit applicable, nous ne sommes pas d'accord à l'effet que l'occupant doit être employé de l'entreprise qui possède le véhicule pour que l'endroit puisse être visé par les sous-alinéas 6(6)a)(i) ou (ii) de la Loi. Nous sommes d'avis qu'une telle condition ne se retrouve pas dans le libellé de la division d)(iii)(A) de la définition d'automobile et que cette division a une portée plus large.

Nous sommes d'avis que le libellé de l'exclusion prévue au sous-alinéa d)(iii) de la définition d'automobile doit être assez large pour permettre, entre autres, au véhicule appartenant à un employé que ce dernier utilise dans le cadre de son emploi dans les conditions prévues par ce sous-alinéa et dont les dépenses ne sont pas remboursées par son employeur, d'être exclus de la définition d'automobile aux fins du calcul de ses dépenses d'emploi. Nous sommes également d'avis que l'exception prévue au sous-alinéa d)(iii) de la définition d'automobile peut même s'appliquer à un travailleur autonome qui utilise principalement son véhicule dans un endroit visé par les sous-alinéas 6(6)a)(i) ou (ii) de la Loi, comme dans la situation que vous nous avez soumise.

Dans la situation que vous nous présentez, nous sommes d'avis que si toutes les autres conditions prévues au sous-alinéa d)(iii) de la définition d'automobile au paragraphe 248(1) de la Loi sont rencontrées, le véhicule détenu par l'entreprise du contribuable ne serait pas une automobile aux fins de la Loi même si l'entreprise du contribuable n'a pas d'employé, puisqu'un ou plusieurs endroits où le véhicule est utilisé sont visés aux sous-alinéas 6(6)a)(i) ou (ii) de la Loi pour ce qui est du contribuable qui conduit le véhicule.

Il est à noter que la question de savoir si un véhicule est utilisé pour fins affaires ou pour fins personnelles est une question de fait qui devra être analysée avant de permettre des déductions relatives au véhicule dans le calcul du revenu de l'entreprise du contribuable. À cette fin, nous vous référons, entre autres à l'opinion 2001-007075A relative aux déplacements des travailleurs forestiers.

Pour ce qui est de la situation où l'entreprise du contribuable louerait le véhicule au lieu de l'acheter, nos conclusions sont les mêmes puisque l'article 67.3 de la Loi s'applique à un véhicule qui est une voiture de tourisme, donc qui rencontre, entre autres, la définition d'automobile prévue au paragraphe 248(1) de la Loi. Dans la présente situation, si l'exception prévue au sous-alinéa d)(iii) de la définition d'automobile s'applique, le véhicule ne serait pas une automobile ni une voiture de tourisme, par conséquent l'article 67.3 de la Loi ne s'appliquerait pas.

Pour votre information, une copie de cette lettre sera épurée selon les critères contenus dans la Loi sur l'accès à l'information et sera disponible dans la Bibliothèque de l'ARC qui se trouve sur votre réseau local ou sur Intranet. Une copie de la version épurée sera également distribuée aux éditeurs fiscaux commerciaux pour insertion dans leurs banques de données. Le processus d'épuration permet d'enlever toute information qui n'a pas à être dévoilée y compris toute information qui permettrait l'identification du contribuable. Si votre client demande une copie de cette lettre, vous pouvez lui remettre une copie épurée de la lettre telle qu'elle se trouve dans la Bibliothèque de l'ARC. Le client peut aussi demander une copie de la lettre épurée en vertu des critères de la Loi sur la protection des renseignements personnels sur laquelle apparaît le nom du contribuable. Toute demande à cet effet devrait être faite auprès de Madame Jackie Page au (819) 994-2898. La copie épurée selon les critères de la Loi sur la protection des renseignements personnels vous sera alors envoyée pour que vous puissiez la remettre à votre client.

In finding that the s. (e)(iii) exclusion applied, CRA stated:

[T]he wording of the exclusion … allow[s], inter alia, an employee's own vehicle that is used in the course of employment under the conditions set out in that subparagraph, and for which the employee's expenses are not reimbursed by the employee's employer, to be excluded from the definition of automobile … . [T]he exception in subparagraph (e)(iii) … may even apply to a self-employed person who primarily uses the individual’s vehicle at a location described in subparagraphs 6(6)(a)(i) or (ii) … .

The same exclusion would apply even if the individual leased rather than owned the truck.
