Can you claim the caregiver amount (line 315)?
Answer
You cannot claim the caregiver amount for a child for whom you have to pay child support, unless you were separated from your spouse or common-law partner for only part of 2016 because of a breakdown in your relationship.
In this case, you can claim either:
- the caregiver amount for that child on line 315, in addition to any allowable amounts on line 305 and line 318
- support amounts paid to your spouse or common-law partner on line 220
You have told us:
- You maintained a dwelling where you and a dependant lived at any time in 2016
- Your dependant is one of the following persons:
- your or your spouse's or common-law partner's child or grandchild
- your or your spouse's or common-law partner's brother, sister, niece, nephew, aunt, uncle, parent, or grandparent who was resident in Canada
- This person was not only visiting you
- Your dependant meets all of the following conditions. Your dependant must have:
- been 18 years of age or older at the time he or she lived with you
- had a net income in 2016 (line 236 of his or her tax return, or the amount that it would be if he or she filed a tax return) of less than $20,607 ($22,728 if he or she is eligible for the family caregiver amount)
- been dependent on you due to an impairment in physical or mental functions or, if he or she is your or your spouse's or common-law partner's parent or grandparent, born in 1951 or earlier
- You have to make child support payments for this dependant
