Regarding whether being granted associate professor status would adversely affect the treatment as a retiring allowance of an amount received by the taxpayer from the university, CCRA stated:

The question of whether an individual has retired or lost employment is a question of fact ... . If the individual concerned does not receive a guarantee or offer of new employment at the time of retirement, we are of the view that the individual has retired.
