Re: Timing of Retiring Allowance Rollovers
This is in reply to your letter of June 16, requesting an advance ruling as to the taxation of a retiring allowance to be paid in the event of a forced termination of employment.
The procedure for requesting an advance income tax ruling is set out in paragraphs 15, 16 and 17 of Information Circular 70-6R (a copy of which is enclosed for your convenience). Paragraphs 21 through to 25 of the Circular discuss the difference between advance rulings and opinions. It should be noted that the fee has been increased to $65 per per hour and a minimum deposit of $325 must accompany the request.
