Objet : Contrat de rentes prescrites
La présente fait suite à votre fac-similé du 7 janvier 2002 dans lequel vous demandez notre interprétation concernant l'application des paragraphes 304(1) et (3) du Règlement de l'impôt sur le revenu (le "Règlement") relativement à quatre situations que vous décrivez dans votre demande.
Tel qu'il est mentionné au paragraphe 22 de la Circulaire d'information 70-6R4 du 29 janvier 2001, nous avons comme pratique de ne pas émettre d'opinion écrite concernant des transactions projetées autrement que par voie de décisions anticipées. Par ailleurs, lorsqu'il s'agit de déterminer si une transaction complétée a reçu le traitement fiscal adéquat, la décision en revient d'abord à nos bureaux des services fiscaux à la suite de l'examen de tous les faits et documents, ce qui est généralement effectué dans le cadre d'une mission de vérification. Nous pouvons toutefois vous offrir les commentaires généraux suivants qui, nous l'espérons, vous seront utiles. Ces commentaires pourraient cependant, dans certaines circonstances, ne pas s'appliquer à votre situation particulière.
L'alinéa 304(1)c) du Règlement prévoit que pour l'application de la partie III du Règlement et des dispositions de la Loi de l'impôt sur le revenu (la "Loi") qui y sont mentionnées, un contrat de rente est un contrat de rente prescrit si, notamment, chaque détenteur est un particulier, à l'exception d'une fiducie qui n'est ni une fiducie visée à l'alinéa 104(4)a) de la Loi ni une fiducie testamentaire et si chaque détenteur est un rentier en vertu du contrat.
L'alinéa 304(3)a) du Règlement prévoit que pour l'application de l'article 304 du Règlement, le rentier en vertu du contrat de rente est réputé en être le détenteur si une autre personne détient le contrat en fiducie pour lui.
Nous sommes d'avis qu'un bénéficiaire d'une fiducie qui détient un contrat de rente n'est pas un rentier en vertu du contrat de rente du seul fait qu'il est un bénéficiaire de la fiducie. Par conséquent, l'alinéa 304(3)a) du Règlement n'aura pas pour effet de réputer le bénéficiaire être le détenteur de ce contrat de rente.
La division 304(1)c)(iv)(B) du Règlement a pour effet d'exiger que les versements de rente soient payables pour une durée déterminée lorsque le détenteur du contrat est une fiducie autre qu'une fiducie visée à l'alinéa 104(4)a) de la Loi. Dans les exemples donnés aux paragraphes 2 et 3 de votre demande, la fiducie n'étant pas une fiducie visée à l'alinéa 104(4)a) de la Loi, nous sommes d'avis que le contrat de rente ne satisferait pas les conditions mentionnées à la division 304(1)c)(iv)(B) du Règlement puisque la rente ne serait pas payable pour une durée déterminée si chaque fiducie testamentaire qui y est décrite est le détenteur du contrat de rente et le rentier en vertu du régime.
En référence au paragraphe 4 de votre demande, nous sommes d'avis que l'alinéa 304(3)a) du Règlement aura pour effet de réputer un rentier en vertu de contrat de rente être le détenteur du contrat, pour les fins de l'article 304 du Règlement, lorsqu'une fiducie détient le contrat pour lui. Pour établir si une personne est un rentier en vertu d'un contrat de rente ou si ce contrat est détenu par une autre personne pour lui, il faut tenir compte de tous les faits pertinents.
Dans le paragraphe 5 de votre lettre, si des enfants deviennent les détenteurs d'un contrat de rente et les rentiers en vertu de ce contrat, nous sommes d'avis que les dispositions de la division 304(1)c)(iv)(B) du Règlement seront rencontrées si les versements de rentes sont payables pour une durée déterminée ou pour la durée décrite à la subdivison 304(1)c)(iv)(B)(I).
En terminant, nous sommes d'avis que les conséquences fiscales au décès du titulaire d'un contrat de rente et l'application de l'alinéa 148(2)b) de la Loi ne peuvent être établies qu'en tenant compte de tous les faits pertinents.
Tel que mentionné dans la Circulaire d'information 70-6R4, la présente opinion ne constitue pas une décision anticipée en matière d'impôt sur le revenu et elle ne nous lie pas.
