Dear XXXXXXXXXX:
This is in reply to your letter dated November 6, 2003, wherein you requested, among other things, certification by Natural Resources Canada ("NRCan") that the principal mineral of gravel to be used in the construction of highways, roads, etc. will be an industrial mineral. As discussed in our telephone conversation of January 19 (XXXXXXXXXX/Bowen), it is NRCan's view that such gravel deposits would not meet the definition of "mineral resource" in subsection 248(1) of the Income Tax Act. Therefore, as per your request, we are not submitting your request for certification to NRCan and are returning your overview material to you.
