Application of Subsection 75(2)
This is in response to your memorandum dated June 9, 1998, concerning the application of subsection 75(2) and will confirm that subsection 75(2) will apply to attribute income “during the lifetime of the person while the person is resident in Canada”. Where the conditions for application of the subsection exist, subsection 75(2) will apply in the year of death or emigration up to the date of death or emigration. Paragraph 1 of IT-369R, Attribution of trust income to settlor also confirms this interpretation in stating that “Subsection 75(2) ceases to apply if the person dies or ceases to be a resident of Canada”.
