This is an assessment of the costs payable to the respondent following
the judgment dated December 13, 2005, dismissing the appeals, with one set of
costs plus disbursements in each file. The assessment proceeded by means of a
telephone conference call on July 27, 2006.

At the beginning of the hearing, counsel for the appellants was under
the impression that bills of costs had been filed in each appeal covered by the
Court of Appeal’s decision. When he realized that only one bill had been
submitted for assessment, he immediately consented to the costs as requested.
Although the mistaken perception of counsel for the appellants resulted in this
telephone conference call, I do not believe that justifies awarding the maximum
number of units set out in section 26 of Tariff B. Therefore, I am allowing
four units for the assessment, since I do not believe that this situation
caused serious prejudice to the respondent.

In conclusion, the respondent’s costs are assessed in the amount of
$2,194.70. A certificate is issued for this amount in docket A-587-04 and a
copy of these reasons will be placed in each of the following dockets:
A-606-04, A-607-04, A-609-04 and A-618-04.
