Sentencing of Regina man and his company for tax evasion upheld upon appeal
Regina, Saskatchewan, November 26, 2015…The Canada Revenue Agency (CRA) announced that, on October 15, 2015, the Regina Court of Appeal upheld the convictions of Gunner Industries Ltd. and Clint Kimery, of Regina, Saskatchewan. Clint Kimery and Gunner Industries Ltd. were fined $150,000 in the Regina Provincial Court on July 26, 2005 after being found guilty of income tax and goods and services tax (GST) evasion for the taxation years 1993 to 1997.
Clint Kimery and Gunner Industries Ltd. failed to report income of $147,421 and failed to collect and remit GST totaling $84,261 for the 1993 to 1997 taxation years. In addition, Clint Kimery appropriated $162,502 from his corporation without reporting it as income on his personal tax returns for the taxation year 1993 to 1997.

When individuals are convicted of income tax and GST evasion, they must still repay the full amount of taxes owing, plus interest and any civil penalties that may be assessed by the CRA. In addition, the court may fine them up to 200% of the taxes evaded and impose a jail term of up to five years.
