Subject: Withholding tax
Problem:
If a dividend, which has been declared, is subsequently waived by the non-resident to whom it would otherwise be paid, does a liability for withholding tax still exist?
Position:
A dividend which has been declared, but not paid, is not considered to have been paid or credited and therefore no withholding tax is exigible under subsection 212(2).
