Do you have any comments on the court decision in the case of The Queen v. Gulf Canada Limited, 92 DTC 6123 (FCA)?
RESPONSE #6
On July 2, 1992, the Supreme Court of Canada dismissed the application for leave to appeal the decision of the Federal Court of Appeal in the case of Gulf Canada Limited. Accordingly, the Department must abide by such decision. However, the Department is still studying its implications and what limits the case set for the industry as a whole to exclude certain expenditures from the calculation of resource profits under section 1204 of the Regulations.
