Raisons:

1. CES MONTANTS REPRÉSENTENT LE REMBOURSEMENT D'UNE DÉPENSE EN CAPITAL PERSONNELLE ET N'EST PAS UNE SOURCE DE REVENU AUX FINS DE LA L.I.R.

2. SELON LA JURISPRUDENCE CANADIENNE, LES INTÉRÊTS ET L'INDEMNITÉ ADDITIONNELLE SE QUALIFIENT D'INTÉRÊTS POUR LES FINS DE L'ALINÉA 12(1)C).

Question 30

Remboursement d'intérêts payés sur un prêt étudiant

À la suite des jugements rendus dans le cadre du recours collectif concernant des prêts étudiants 1997-1998 (Harry Dikranian c. Procureur général du Québec), plusieurs résidents du Québec ont droit de recevoir un remboursement à l'égard d'intérêts payés en trop sur certains prêts étudiants.

Or, en vertu de l'article 118.62 L.I.R, les intérêts payés sur un prêt étudiant donnent droit à un crédit d'impôt. Par ailleurs, un tel crédit peut faire l'objet d'un report prospectif sur les cinq années subséquentes.

Quel sera le traitement fiscal des remboursements reçus par les contribuables dans le cadre de ce recours collectif?

Réponse de l'ARC

Nous comprenons que suite au recours collectif dont l'objet était la récupération d'intérêts payés sur des prêts étudiants octroyés sous le régime de l'ancienne Loi sur l'aide financière aux étudiants (LAFE), le Gouvernement du Québec doit rembourser les intérêts chargés sur des prêts avant la fin de la période d'exemption prévue par l'ancienne LAFE. Le montant payable porte intérêt au taux légal à compter du 10 juin 1999, plus l'indemnité additionnelle prévue au Code civil du Québec.

Dans le cas d'espèce, nous sommes d'avis que le montant des intérêts remboursés qui sera reçu par les contribuables ne sera pas imposable aux fins de la L.I.R.

Toutefois, le montant d'intérêt au taux légal ainsi que l'indemnité additionnelle constituent des intérêts et devront être ajoutés dans le calcul du revenu d'un contribuable en vertu de l'alinéa 12(1)c) L.I.R. dans l'année où ils sont reçus ou à recevoir, selon la méthode que le contribuable suit normalement pour le calcul de son revenu.

Question 30

Repayment of Interest Paid on a Student Loan

Following the decisions rendered in the course of a class action concerning student loans 1997-1998 ((Harry Dikranian v. The Attorney General of Québec), several residents of Québec are entitled to receive a repayment of over-paid interest on certain student loans.

Pursuant to section 118.62 of the ITA, however, the interest paid on a student loan results in an entitlement to a tax credit. Additionally, such a credit can be the subject of a carry-forward over the five subsequent years.

Question

What will be the tax treatment of the repayments received by the taxpayers in the course of this class action?

CRA Response

We understand that following the collective recourse whose purpose was to recover interest paid on student loans granted under the old Act Respecting Financial Assistance for Students (ARFAS), the Government of Québec must repay the interest charged on loans before the end of the exemption period provided by the old ARFAS. The amount payable bears interest at the legal rate commencing on June 10, 1999, plus an additional indemnity provided in the Civil Code of Québec.

In this case, we are of the view that the amount of the repayment of interest which will be received by the taxpayers will not be taxable for the purposes of the ITA.

The amount of interest at the legal rate as well as the additional indemnity, however, constitute interest and will have to be added in computing the taxpayer's income pursuant to paragraph 12(1)(c) of the ITA in the year they are received or receivable, depending on the method regularly followed by the taxpayer in computing his income.
