Application des paragraphes 248(35) à 248(37) à un don d'une police d'assurance-vie
Selon les propositions législatives contenues dans le projet de loi C-10 1 que le sénat a adopté en deuxième lecture le 4 décembre 2007, le total des dons de bienfaisance est fonction du montant admissible d'un don. Le paragraphe 248(31) L.I.R., tel qu'il est proposé, édicte que le montant admissible d'un don correspond à l'excédent de la juste valeur marchande (ci-après " JVM ") d'un bien qui fait l'objet du don sur le montant de l'avantage, le cas échéant, au titre du don.
L'année dernière, lors de la table ronde sur la fiscalité des stratégies financières et des instruments financiers, l'ARC indiquait qu'il faut tenir compte des facteurs énumérés dans la circulaire d'information 89-3 2 pour établir la juste valeur marchande d'une police d'assurance-vie donnée à un donataire reconnu, et que le paragraphe 3 du bulletin d'interprétation IT-244R3 3 doit être lu en tenant compte de cette nouvelle position de l'ARC.
Les paragraphes 248(35) à (37) L.I.R., tels qu'ils sont proposés, prévoient des règles particulières afin de déterminer la JVM d'un bien faisant l'objet d'un don.
Le paragraphe 248(35) L.I.R., tel qu'il est proposé, édicte que si l'un des faits suivants se vérifie, la JVM du bien donné est réputée correspondre à sa JVM déterminée par ailleurs, ou s'il est moins élevé, à son coût ou, s'il s'agit d'une immobilisation, à son prix de base rajusté immédiatement avant que le don soit fait :
a) Le contribuable a acquis le bien faisant l'objet du don dans le cadre d'un arrangement de don qui est un abri fiscal au sens du paragraphe 237.1(1) L.I.R.
b) Le contribuable a acquis le bien faisant l'objet du don moins de trois ans avant la date du don (sauf si le don est fait par suite du décès).
c) Le contribuable a acquis le bien faisant l'objet du don moins de dix ans avant la date du don (sauf si le don est fait par suite du décès du contribuable) et il est raisonnable de conclure, au moment de l'acquisition du bien donné, que l'une des principales raisons de son acquisition était de faire le don.
Le paragraphe 248(37) L.I.R. exclut plusieurs types de dons de l'application du paragraphe 248(35) L.I.R., dont les suivants :
les dons d'inventaire,
les dons de biens immeubles ou réels situés au Canada,
les dons de biens culturels,
les dons de certaines actions.
Toutefois, le don des polices d'assurance-vie n'est pas exclu de l'application du paragraphe 248(35) L.I.R., tel qu'il est proposé.
Il se peut qu'un contribuable fasse l'acquisition d'une police d'assurance-vie pour couvrir un besoin temporaire, ou qu'il planifie faire un don important éventuellement. Voici deux exemples :
Un individu qui est propriétaire d'une entreprise acquiert une police d'assurance-vie, dont sa vie est assurée, pour couvrir ses impôts au décès. Deux ans après l'acquisition de la police, il vend son entreprise et paie les impôts découlant de la vente. Moins de trois ans après l'acquisition de la police d'assurance-vie, il la donne à un organisme de bienfaisance enregistré.
Un individu sachant que le coût de l'assurance-vie croît avec l'âge décide d'acheter une police d'assurance-vie avec l'intention de la donner plus tard à un organisme de bienfaisance enregistré. Après huit ans de détention de la police, il crée une fondation privée de bienfaisance et donne sa police à la fondation alors que celle-ci est un organisme de bienfaisance enregistré. Il continuera de payer la prime chaque année.
Dans les deux situations, la police d'assurance-vie est entièrement cédée à un donataire reconnu et ce dernier en devient le titulaire et le bénéficiaire.
Question
Est-ce que l'ARC partage notre avis, à l'effet que le paragraphe 248(35) L.I.R. ne devrait pas s'appliquer et qu'il y aurait lieu d'ajouter aux exceptions prévues au paragraphe 248(37) L.I.R. le don de polices d'assurance-vie ?
Réponse
L'ARC est d'avis que le paragraphe 248(35) L.I.R., tel que proposé, s'appliquera pour établir la juste valeur marchande de la police d'assurance-vie donnée dans les deux situations décrites ci-dessus.
La question de savoir s'il y a lieu d'ajouter le don de polices d'assurance-vie à la liste des exceptions énumérées au paragraphe 248(37) L.I.R., tel que proposé, en est une de politique fiscale et relève du ministère des Finances.
Concernant le paiement des primes, il est mentionné au bulletin d'interprétation IT-244R3 4 que " si les primes de la police sont payées directement à la compagnie d'assurance et ce, à la demande du donataire ou avec son accord, il s'agit du versement réputé d'un don au donataire et, par conséquent, d'un don de charité aux fins de la Loi. ". L'ARC est d'avis que le paragraphe 248(35) L.I.R., tel que proposé, n'aura pas d'impact quant au paiement en argent des primes que l'individu continuera de payer comme il est mentionné dans l'énoncé de la question.

Gift of a Life Insurance Policy and Subsections 248(35) to 248(37) of the ITA
Under the legislative proposals contained in Bill C-10 5 , which received second reading in the Senate on December 4, 2007, the total charitable gifts depends on the eligible amount of a gift. Proposed subsection 248(31) of the ITA stipulates that the eligible amount of a gift is the amount by which the fair market value (hereafter "FMV") of the property that is the subject of the gift exceeds the amount of the advantage, if any, in respect of the gift.
At last year's Round Table on the Taxation of Financial Strategies and Instruments, the CRA indicated that the factors listed in Information Circular 89-3 6 must be taken into account in establishing the fair market value of a life insurance policy gifted to a qualified donee and that paragraph 3 of Interpretation Bulletin IT-244R3 7 must be read taking into account this new position of the CRA.
Proposed subsections 248(35) to (37) of the ITA provide particular rules in order to determine the FMV of a property that is the subject of a gift.
Proposed subsection 248(35) of the ITA stipulates that if one of the following statements is confirmed, the FMV of the property that is the subject of a gift is deemed to be the lesser of its FMV otherwise determined and its cost, or in the case of capital property, its adjusted cost base, immediately before the gift is made:
a) The taxpayer acquired the property that is the subject of the gift under a gifting arrangement that is a tax shelter as defined in subsection 237.1(1) of the ITA.
b) The taxpayer acquired the property that is the subject of the gift less than 3 years before the day that the gift is made (except if the gift is made as a consequence of death).
c) The taxpayer acquired the property that is the subject of the gift less than 10 years before the day that the gift is made (except if the gift is made as a consequence of the taxpayer's death) and it is reasonable to conclude that, at the time the taxpayer acquired the property, one of the main reasons for the acquisition was to make a gift.
Subsection 248(37) of the ITA excludes several types of gifts from the application of subsection 248(35) of the ITA, including the following:
gifts of inventory,
gifts of real property or an immovable situated in Canada,
gifts of cultural property,
gifts of certain shares.
The donation of life insurance policies is, however, not excluded from the application of proposed subsection 248(35) of the ITA.
A taxpayer may acquire a life insurance policy to meet a temporary need or he plans to eventually make an important gift. Here are two examples:
An individual who is the owner of a business acquires a life insurance policy, under which his own life is insured, in order to cover his taxes at death. Two years after acquiring the policy, he sells his business and pays the taxes arising from the sale. Less than three years after acquiring the life insurance policy, he gifts it to a registered charity.
An individual who is aware that the cost of life insurance increases with age decides to purchase a life insurance policy with the intention of gifting it later to a registered charity. After holding the policy for eight years, he creates a private charitable foundation and gifts his policy to the foundation which is a registered charity. He will continue to pay the premium each year.
In both situations, the life insurance policy is fully assigned to a qualified donee who becomes the policyholder and the beneficiary.
Does the CRA share our view that subsection 248(35) of the ITA should not apply and that it would be appropriate to add to the exceptions provided in subsection 248(37) of the ITA, the donation of life insurance policies?
CRA Response
The CRA is of the view that proposed subsection 248(35) of the ITA will apply to establish the fair market value of the life insurance policy that was subject to a gift in the two situations described above.
Whether or not it is appropriate to add the gifting of life insurance policies to the list of exceptions enumerated in proposed subsection 248(37) of the ITA is a matter of tax policy and such is the responsibility of the Department of Finance.
With respect to the payment of premiums, Interpretation Bulletin IT-244R3 8 states that "if the premiums on the policy are paid directly to the insurance company at the request of, or with the concurrence of, the donee, this action is considered to be constructive payment of a donation to the donee and therefore a charitable gift for the purposes of the Act." The CRA is of the view that proposed subsection 248(35) of the ITA will not have an impact on the cash payment of the premiums that the individual will continue to make, as stated in the question.
