Compensation des intérêts sur les paiements d'impôt excédentaires ou insuffisants de particuliers
Un particulier qui effectue des paiements d'impôt excédentaires peut avoir droit à des intérêts sur les paiements en trop de la part de l'ARC. Ces intérêts sont inclus dans le calcul du revenu imposable, de même que les intérêts provenant d'autres sources. À l'opposé, le particulier qui n'a pas acquitté la totalité de l'impôt payable à l'échéance fixée doit verser des intérêts sur arriérés à l'ARC. Ces intérêts ne sont pas déductibles dans le calcul du revenu imposable.
L'imposition des intérêts sur paiement en trop et la non-déductibilité des intérêts sur arriérés peut donner des résultats inéquitables dans les cas où un particulier qui doit payer des intérêts au titre d'un montant d'impôt impayé pour une année d'imposition donnée, a droit à des intérêts sur paiement en trop pour une autre année d'imposition, entre autres, si l'imposition d'un revenu doit être déplacée d'une année à une autre.
Le coût des intérêts non déductibles payables par le particulier dépasse alors la valeur après impôt de l'intérêt imposable devant lui être versé. Cet écart découle de la non-déductibilité des intérêts payés et de l'inclusion des intérêts reçus dans le calcul du revenu, et du fait que le taux prescrit à l'égard des montants payables aux contribuables soit inférieur à celui payable à l'ARC.
Compte tenu que les sociétés bénéficiaient déjà du mécanisme de compensation des intérêts créditeurs et des intérêts débiteurs de l'article 161.1 L.I.R et de la situation non souhaitable applicable aux particuliers, un mécanisme d'allégement a été annoncé pour les particuliers (sauf les fiducies) dans le budget du 28 février 2000.
Le mécanisme est à l'effet que les intérêts payables à un contribuable pour paiement en trop d'une période donnée ne seront imposables que dans la mesure où ils excèdent les intérêts accumulés durant la même période (applicables aux intérêts accumulés de façon simultanée après 1999). Dans le document d'information accompagnant le Communiqué 00-101 du 21 décembre 2000 du ministère des Finances, il était annoncé que l'ARC et le ministère des Finances travaillaient "à élaborer un mécanisme qui permettrait de concrétiser cette proposition". Toutefois, aucun texte législatif n'a encore été sanctionné à l'égard de cette mesure ; et ce, malgré les représentations du comité mixte du droit fiscal de L'Association du Barreau canadien et de l'ICCA présentées le 21 juin 2005.
L'ARC peut-elle nous confirmer qu'elle permet à un particulier de calculer son revenu en fonction de l'annonce budgétaire du 28 février 2000, et ce, avec les mêmes dates d'application?

Offsetting of Interest on Tax Overpayments and Underpayments by Individuals
An individual who makes overpayments of income tax may be entitled to receive interest on the overpayments from the CRA. This interest is included in the computation of taxable income, in the same manner as interest from other sources. On the other hand, the individual who has failed to pay an amount of income tax when due, is required to pay interest on late balances to the CRA. This interest is not deductible in computing taxable income.
The taxation of interest on overpayments and the non-deductibility of interest on late balances can produce inequitable results in situations where an individual who owes interest on unpaid tax for a particular taxation year is entitled to receive interest on a tax overpayment for a different taxation year, among others, if the taxation of income must be moved from one year to another.
The cost of the non-deductible interest payable by the individual then exceeds the after-tax value of the taxable interest receivable by the individual. This difference results from the non-deductibility of interest paid and the inclusion of interest received in the computation of income, and given the fact that the prescribed rate with respect to the amounts payable to the taxpayers is lower than the one payable to the CRA.
Given that corporations already benefit from the mechanism of offsetting refund interest and arrears interest as provided in section 161.1 of the ITA and the undesirable results applicable to individuals, a relieving mechanism was announced for individuals (except trusts) in the budget of February 28, 2000.
The mechanism provides that the interest payable to a taxpayer in respect of overpayments for a particular period will be taxable only to the extent that they exceed the interest accruing over the same period (applicable to interest that accrue concurrently after 1999). In the Backgrounder accompanying the News Release 00-101 of December 21, 2000, issued by the Department of Finance, it was announced that the CRA and the Department of Finance were working to "develop a mechanism under which this proposal can be given effect". However, no legislation has been enacted with respect to this measure, even though representations were made by the joint committee on tax law of the Canadian Bar Association and the CICA on June 21, 2005.
Can the CRA confirm that it allows an individual to calculate its income in accordance with the budget announcement made on February 28, 2000 and with the same application dates?
