Imposition de pénalités par l'ARC à l'égard de formulaires non produits
Nous comprenons que l'ARC a comme position administrative de ne pas appliquer une pénalité à l'égard de la production tardive du formulaire prescrit T1134 relatif aux opérations étrangères avec une société étrangère ou du formulaire prescrit T1044 relatif aux renseignements des organismes sans but lucratif (ci-après "OSBL"), produit à l'initiative du contribuable. D'ailleurs, lors de la Table ronde sur la fiscalité fédérale du Congrès 2004 de l'APFF, l'ARC mentionnait que:
La pénalité pour production tardive prévue au paragraphe 162(7) L.I.R. n'est généralement pas imposée lorsque le contribuable produit volontairement, mais tardivement, la déclaration et que c'est la première fois qu'il produit une déclaration de biens étrangers en retard. Une lettre d'avertissement est envoyée au contribuable afin de l'informer qu'une pénalité n'est pas imposée vu que c'est la première fois qu'il produit une déclaration en retard, mais la prochaine fois, il sera passible d'une pénalité.
Cette politique administrative est en place afin de fournir une alternative simple à la procédure formelle de divulgation volontaire, lorsque la déclaration de renseignements sur les sociétés étrangères n'a pas été produite en retard auparavant. Cependant, rien n'empêche un contribuable d'utiliser la procédure formelle de divulgation volontaire, soit la première fois qu'il produit sa déclaration en retard ou pour les fois subséquentes.
Toutefois, depuis 2006, nous avons connaissance de situations où des pénalités atteignant 2 500 $ par infraction ont été imposées, même s'il s'agissait d'une première "offense". À titre d'exemple seulement, nous avons pu voir l'imposition d'une pénalité de 2 500 $ à un OSBL pour la production tardive du formulaire prescrit T1044.
L'ARC peut-elle préciser sa politique administrative présentement en vigueur quant à l'imposition de la pénalité, prévue au paragraphe 162(7) L.I.R. (ci-après la "Pénalité"), à l'égard d'une première infraction pour la production tardive des formulaires prescrits T1044, T1134A, T1134B et T1135?
Dans le cas où un changement à cette politique administrative serait introduit, serait-il possible d'en informer les contribuables et leurs représentants via une annonce formelle, par exemple, l'émission d'un communiqué de presse? De plus, advenant un changement à cet égard serait-il possible de prévoir une période de moratoire pour permettre au contribuable et à leur représentant de compléter une production en cours?

Formulaires relatifs aux opérations étrangères
Contrairement à ce qui avait été mentionné lors de la table ronde sur la fiscalité fédérale du Congrès 2004 de l'APFF, l'ARC, depuis le 1er janvier 2006, applique la Pénalité dans tous les cas où un formulaire prescrit T1134A, T1134B ou T1135 est produit en retard. Il en ainsi également pour les formulaires prescrits T1141, T1142 ainsi que le T106.
Formulaire relatif aux renseignements des OSBL
L'ARC a comme politique administrative de ne pas appliquer la Pénalité lorsqu'un formulaire prescrit T1044 est produit en retard pour la première fois.
Émettre une cotisation relativement à l'application de la Pénalité à un OSBL dans le cas que vous citez en exemple, semble contraire à la position administrative de l'ARC. Par conséquent, nous sommes d'avis que cet OSBL pourrait demander à l'ARC d'annuler la Pénalité, en vertu du paragraphe 220(3.1) L.I.R., en faisant parvenir une telle demande à la division administrative suivante:

En ce qui concerne votre deuxième question, l'ARC a comme politique, en général, d'informer le public lorsqu'elle adopte une position administrative ou l'abandonne et parfois d'accorder une période d'allégement transitoire. On doit reconnaître que l'ARC n'a pas annoncé publiquement l'abandon de sa politique administrative en ce qui concerne l'application de la Pénalité à l'égard de l'omission de produire les formulaires relatifs aux opérations étrangères. Par contre, un contribuable ou une société de personnes sujettes à la Pénalité en raison de la production tardive de formulaires relatifs aux opérations étrangères peut toujours se prévaloir des dispositions du paragraphe 220(3.1) L.I.R. et demander au Ministre d'annuler la Pénalité. Une telle demande en vertu du paragraphe 220(3.1) L.I.R., bien que sujette à la discrétion de l'ARC, constitue quand même une alternative valable dans les circonstances ; et peut être faite par le contribuable ou la société de personnes au bureau des services fiscaux de sa région.

Application of Non-Filing Penalties by the CRA
We understand that the CRA has an administrative position which is not to apply a late-filing penalty with respect to prescribed form T1134 relating to foreign transactions with a foreign affiliate or prescribed form T1044 relating to information of non-profit organizations (hereafter "NPO"), produced on the taxpayer's initiative. Moreover, during the Round Table on the Federal Taxation of the 2004 APFF Conference, the CRA mentioned that:
The subsection 162(7) of the ITA late-filing penalty is not normally imposed when the taxpayer files the return voluntarily, but late, and it is the first time he or she files a foreign property return late. A letter of warning is sent to the taxpayer to inform him or her that a penalty has not been imposed because it is the first time he or she has filed a return late, but a penalty will be imposed next time.
This administrative policy is in place to provide a simple alternative to the formal voluntary disclosure procedure when it is the first time an information return relating to foreign corporations is late. However, there is nothing to prevent a taxpayer from using the formal voluntary disclosure procedure the first time or subsequent times his or her return is late.
Since 2006, however, we are aware of situations where penalties reaching $2,500 per violation were imposed, even if such pertained to a first "offence". As an example only, we have seen the imposition of a penalty of $2,500 on an NPO for the late-filing of the prescribed form T1044.
Can the CRA specify its current administrative policy on the imposition of the penalty under subsection 162(7) of the ITA (hereafter the "Penalty"), in respect of the first violation dealing with the late filing of prescribed forms T1044, T1134A, T1134B and T1135?
In a situation where a change would be made to this administrative policy, would it be possible to inform the taxpayers and their representatives by way of a formal announcement, for example, the issuance of a press release? Moreover, if a change is effected in this respect, would it be possible to foresee a moratorium period to allow the taxpayer and its representative to complete a filing in progress?

Forms relating to foreign transactions
Since January 1, 2006 and contrary to what was mentioned during the Round Table on the Federal Taxation of the 2004 APFF Conference, the CRA applies the Penalty in all cases where prescribed form T1134A, T1134B or T1135 is late-filed. This also applies to prescribed forms T1141, T1142 and T106.
Form relating to information on NPOs
The CRA administrative policy is not to apply the Penalty when prescribed form T1044 is late-filed for the first time.
Particular case
To issue an assessment in regard to the application of the Penalty to an NPO in the case of the example you cited seems contrary to the administrative policy of the CRA. Consequently, we are of the opinion that this NPO could request that the CRA cancels the Penalty, in accordance with subsection 220(3.1) of the ITA, by forwarding such a request to the following administrative division:

Administrative positions
With regard to your second question, the CRA's policy, generally, is to inform the public when it adopts or withdraws an administrative position and it sometimes grants a transitional period of relief. One must recognize that the CRA did not publicly announce the withdrawal of its administrative policy concerning the application of the Penalty with respect to the non-filing of the forms relating to foreign transactions. However, a taxpayer or a partnership subject to the Penalty, because of the late-filing of forms relating to foreign transactions, can use the provisions of subsection 220(3.1) of the ITA and request that the Minister cancel the Penalty. A request made under subsection 220(3.1) of the ITA, although subject to the discretion of the CRA, nevertheless constitutes a valid alternative in the circumstances. The taxpayer or the partnership can address such a request to their local tax services offices.
