Fiducie pour l'environnement
X Co. est une société exploitant une entreprise qui opère des sites d'enfouissement qu'elle possède. Par le biais d'un décret adopté en vertu de la Loi sur la qualité de l'environnement, le gouvernement du Québec accorde à X Co. le droit d'exploiter un nouveau site d'enfouissement à la condition de verser des sommes dans une fiducie pour la restauration de ce site à la fin de la période d'exploitation de celui-ci.
a) L'ARC considère-t-elle que le "maintien de la fiducie [est] (...) prévu (...) par une loi fédérale ou provinciale" aux fins de la définition de "fiducie pour l'environnement admissible" au paragraphe 248(1) L.I.R?
b) Dans la mesure où la fiducie ne constituerait pas une fiducie pour l'environnement admissible aux fins de la L.I.R., X Co. pourrait-elle déduire les montants versés annuellement à la fiducie sur la base de l'alinéa 20(1)m) L.I.R?
c) Les revenus de placements d'une fiducie pour l'environnement admissible sont composés d'intérêts sur des placements décrits à l'un des alinéas a), b) et f) de la définition de "placement admissible" prévue à l'article 204 L.I.R., et ce, conformément à l'alinéa e) de la définition de "fiducie pour l'environnement admissible" prévue au paragraphe 248(1) L.I.R. Le revenu net d'intérêts gagnés par la fiducie est attribué à X Co. sur la base de l'alinéa 107.3(1)a) L.I.R. Ce revenu net constitue-t-il du revenu d'entreprise ou du revenu de bien pour les fins de la L.I.R.? Dans la mesure où il s'agit de revenu de bien, ce revenu génère-t-il pour X Co. de l'impôt en main remboursable au titre de dividendes en vertu du paragraphe 129(3) L.I.R. ?
Réponse de l'ARC
En général, une fiducie qui serait constituée par une personne qui exploite une nouvelle installation d'élimination de matières résiduelles qu'elle possède, en raison de l'application par le gouvernement de la province de Québec de l'exigence prévue à l'article 56 de la Loi sur la qualité de l'environnement, constituerait une fiducie dont le maintien est prévu par une loi provinciale aux fins de l'application de la définition de "fiducie pour l'environnement admissible" au paragraphe 248(1) L.I.R.
Nous ne pouvons nous prononcer concernant l'application de l'alinéa 20(1)m) L.I.R. à l'égard d'une situation hypothétique pour laquelle nous n'avons pas suffisamment de faits.
En ce qui concerne la dernière question, nous sommes d'avis qu'en général, un revenu d'intérêt attribué à une société en raison de l'alinéa 107.3(1)a) L.I.R. pourrait être considéré comme un revenu qui se rapporte directement ou accessoirement à son entreprise aux fins du calcul du "revenu de la société pour l'année provenant d'une entreprise exploitée activement" au sens de la définition prévue au paragraphe 125(7) L.I.R.
De plus, nous sommes d'avis qu'en général, un tel revenu ne pourrait être pris en compte aux fins de l'impôt en main remboursable au titre de dividendes en raison du sous-alinéa b)(i) de la définition de "revenu" au paragraphe 129(4) L.I.R. qui prévoit que le revenu d'une société tiré d'une source qui est un bien ne comprend pas le revenu tiré d'un bien qui se rapporte directement ou accessoirement à une entreprise qu'elle exploite activement.

Environmental Trust
XCo is a corporation carrying on a business which operates landfill sites that it owns. By an Order in Council enacted pursuant to the Environment Quality Act, the Quebec Government grants to XCo the right to operate a new landfill site on the condition that amounts must be paid to a trust to fund the reclamation of this site at the end of its operating period.
(a) Does the CRA consider that the "maintenance of the trust is (...) required under a law of Canada or the province" for the purposes of the definition of "qualifying environmental trust" in subsection 248(1) of the ITA?
(b) To the extent that the trust would not constitute a qualifying environmental trust for the purposes of the ITA, could XCo deduct the amounts paid annually to the trust pursuant to paragraph 20(1)(m) of the ITA?
(c) The investment income of a qualifying environmental trust consists of interest on investments described in one of the paragraphs (a), (b) and (f) of the definition "qualified investment" provided in section 204 of the ITA, that is, in accordance with paragraph (e) of the definition "qualifying environmental trust" provided in subsection 248(1) of the ITA. The net income from interest earned by the trust is attributed to XCo pursuant to paragraph 107.3(1)(a) of the ITA. Does this net income constitute business income or property income for the purposes of the ITA? To the extent that it is property income, does this income generate refundable dividend tax on hand for XCo pursuant to subsection 129(3) of the ITA?
The CRA's Response
Generally, a trust that would be created by a person who operates a new residual materials elimination facility that it owns, because of the application by the Government of the Province of Quebec of the requirement provided in section 56 of the Environment Quality Act, would constitute a trust for which the maintenance is required under a law of the province for purposes of the definition "qualifying environmental trust" in subsection 248(1) of the ITA.
We cannot give an opinion concerning the application of paragraph 20(1)(m) of the ITA in respect of a hypothetical situation for which we do not have sufficient facts.
With respect to the last question, we are of the opinion that, in general, the interest income attributed to a corporation pursuant to paragraph 107.3(1)(a) of the ITA could be considered as income pertaining to or incident to its business for the purposes of computing the "income of the corporation for the year from an active business" within the meaning of the definition provided in subsection 125(7) of the ITA.
Moreover, we are of the opinion that, in general, such income could not be taken into account for the purposes of the refundable dividend tax on hand by reason of subparagraph (b)(i) of the definition of "income" in subsection 129(4) of the ITA which provides that the income of a corporation from a source that is a property does not include the income from any property that is incident to or pertains to an active business carried on by it.
