Question 1: Achat d'obligation sur le marché par l'émetteur - traitement pour le détenteur
Il arrive que des émetteurs publics désirent racheter leurs propres obligations en circulation. Ils peuvent le faire en faisant un rachat de titre ou bien en achetant le titre sur le marché libre.
Le rachat de titre par l'émetteur donne lieu à un intérêt pour le détenteur avec une émission d'un feuillet T5. Lors d'un achat sur le marché libre un feuillet T5008 est émis.
Puisqu'il est impossible d'associer un vendeur avec un acheteur lors de la vente d'un titre sur le marché libre, pouvez-vous confirmer si cette transaction donne lieu à une disposition pouvant générer un gain en capital ou non?
Réponse de l'ARC
À notre avis, une opération sur le marché libre en vertu de laquelle l'obligation détenue par un individu est achetée, lui donnant droit de recevoir un produit à titre de contrepartie, est généralement une opération qui constitue une disposition selon l'alinéa a) de la définition de "disposition" prévue au paragraphe 248(1) de la Loi de l'impôt sur le revenu 1 . Cet alinéa stipule que toute opération ou tout événement donnant droit au contribuable au produit de disposition d'un bien est une disposition.
Par conséquent, un individu qui dispose d'une telle obligation détenue comme investissement sur le marché libre peut réaliser un gain en capital ou subir une perte en capital. De plus, il doit inclure dans le calcul de son revenu les intérêts courus calculés selon le taux d'intérêt inscrit sur l'obligation jusqu'à la journée de la disposition de l'obligation. Généralement, l'émetteur d'un contrat de placement est tenu d'établir un feuillet T5 pour un tel contrat et d'y inscrire le total des intérêts courus au jour anniversaire (journée de la disposition) qui n'ont pas été antérieurement inscrit sur un tel feuillet.

Question 1: Acquisition of a Bond on the Market by the Issuer - Treatment of the Bondholder
Public issuers sometimes wish to buy back their own outstanding bonds. They may do this by a redemption of the security or by an acquisition of the security on the open market.
A security redemption by the issuer generates interest for the bondholder and the issuance of a T5 slip. A T5008 slip is issued with respect to the acquisition on the open market.
Given that it is impossible to link a seller and a purchaser at the time of the sale of a security on the open market, can you confirm whether or not this transaction gives rise to a disposition that may generate a capital gain?
CRA Response
In our opinion, a transaction on the open market by which a bond held by an individual is acquired, entitling the individual to receive proceeds in consideration, is generally a transaction that constitutes a disposition according to paragraph a) of the definition of "disposition" provided in subsection 248(1) of the Income Tax Act 2. This paragraph stipulates that any transaction or event entitling a taxpayer to proceeds of disposition of the property is a disposition.
As a result, an individual who disposes of such a bond held as an investment on the open market may realize a capital gain or incur a capital loss. In addition, the individual must include in the computation of his income, the accrued interest calculated according to the interest rate on the bond until the day of disposition of the bond. Generally, the issuer of an investment contract must prepare a T5 slip for such contract and must indicate thereon the total interest that accrued on the anniversary day (the day of the disposition) which was not previously indicated on such a slip.
