Question 40

Frais de décontamination des sols

L'ARC a indiqué dans l'interprétation 9328197 que le coût de décontamination d'un terrain était une dépense de nature capitale. Cependant, si le terrain doit être décontaminé à la suite d'un événement survenu après l'acquisition du terrain (par exemple, suite à une fuite d'huile imprévue survenue quelques années après l'achat), les frais encourus n'ont pour objet que de ramener le terrain à son état au moment où le bien était acquis.

L'ARC est-elle d'accord à l'effet qu'il pourrait donc s'agir d'une dépense de nature courante déductible dans le calcul du revenu d'entreprise ou de bien si le terrain était utilisé pour produire un tel revenu (à titre d'exemple, dans le cas d'un immeuble locatif)?

Réponse de l'ARC

La question de déterminer le traitement fiscal à accorder à une dépense en est une de fait qui dépend des circonstances particulières de chaque cas. Dans l'interprétation technique 9328197, l'ARC avait déterminé que les frais de décontamination étaient de nature capitale puisque la décontamination du site était une condition à l'obtention de financement. L'ARC avait conclu que l'effet de la décontamination était d'améliorer l'état du terrain pour que celui-ci constitue une garantie acceptable pour l'institution prêteuse.

Toutefois, l'ARC est également d'avis que les coûts de décontamination d'un terrain peuvent constituer une dépense de nature courante si ces coûts sont engagés par un contribuable pour corriger une situation causée par l'exploitation de son entreprise, et que ces frais ne font que ramener le terrain à son état avant la contamination.

Dans l'interprétation technique 9413377, le contribuable avait entrepris des activités de production de phosphore, de nitrogène et d'ammoniaque. La production de phosphore avait causé d'importants dégâts environnementaux et le contribuable s'est vu dans l'obligation de procéder à la décontamination des terrains. L'ARC a conclu que les frais de décontamination constituaient des dépenses de nature courante.

De la même façon, dans l'interprétation 2001-0101055, l'ARC a conclu que des frais de décontamination engagés suite à l'exploitation d'une station-service étaient de nature courante puisque la contamination du terrain était directement liée aux activités de l'entreprise du contribuable.

Question 40

Soil Decontamination Expenses

The CRA has indicated in technical interpretation #9328197 that expenses incurred to decontaminate land represented a capital expenditure. However, if the land has to be decontaminated following an event that occurred after its acquisition (e. g. from an unexpected oil spill that took place a few years after the acquisition), the expenses are only incurred for the purpose of bringing back the land to its condition when it was purchased.

Does the CRA agree these expenses could then be current expenses that are deductible in the calculation of business or property income if the land has been used to generate such income (e.g. in the case of a rental building)?

CRA's Response

The question of determining the tax treatment of an expense is a question of fact that revolves around the particular circumstances of each case. In technical interpretation #9328197, the CRA had determined that decontamination costs were capital expenditures since the decontamination of the site was a condition to obtain financing. The CRA concluded that the effects of the clean-up were to improve the condition of the land so as to constitute an acceptable guarantee for the lending institution.

However, the CRA is also of the opinion that land decontamination costs can be viewed as current expenses if a taxpayer incurs these costs in order to correct a situation caused by the carrying on of the taxpayer's business and if these costs are made for the sole purpose of bringing back the land to its condition prior to the contamination.

In technical interpretation #9413377, the taxpayer had started activities of producing phosphorous, nitrogen and ammonia. The production of phosphorous had caused some serious environmental damages, and the taxpayer was forced to proceed with the decontamination of the land. The CRA had concluded that the decontamination costs constituted normal current expenses.

In the same way, in technical interpretation # 2001-0101055, the CRA had concluded that the decontamination costs incurred following the operation of a gas station were current expenses since the decontamination of the land was directly related to the taxpayer's business activities.
