Position: No, even though technically interest charges apply.

Intérêts et report rétrospectif de pertes

Le paragraphe 161(7) L.I.R. est pertinent au calcul des intérêts. Il prévoit notamment que dans le cas d'un report rétrospectif de pertes, on ne tient compte du report pour le calcul des intérêts qu'à compter de la date de la demande de report, en règle générale.

Il peut arriver que dans l'année à laquelle la perte est reportée (ci-après "l'année initiale"), le contribuable n'avait pas d'impôt payable. Par exemple, un contribuable pouvait avoir réclamé un crédit d'impôt étranger qui ramenait son impôt à zéro. Dans une année subséquente, une perte est subie. Cette perte est reportée rétrospectivement à "l'année initiale". Le report est aussi effectué dans la juridiction étrangère, de sorte que le contribuable n'a plus d'impôt étranger et n'a plus droit au crédit d'impôt étranger. Dans ce cas, le paragraphe 161(7) L.I.R. fait en sorte que des intérêts seront calculés bien que, en fait, le contribuable n'a jamais eu de montant à verser en impôt pour "l'année initiale", soit parce qu'un crédit d'impôt étranger était disponible, soit parce que des pertes étaient reportées.

Est-ce que l'ARC est d'accord avec cette interprétation? Si oui, est-ce une situation qui pourrait être considérée favorablement dans le cadre du dossier équité?

Réponse de l'ARC

Nous sommes d'avis que, techniquement, votre interprétation des paragraphes 161(1) et (7) L.I.R. est correcte dans l'exemple donné.

Cependant, l'ARC a comme pratique administrative de longue date de ne pas charger d'intérêt, en vertu du paragraphe 161(1) L.I.R., lors de l'établissement d'une nouvelle cotisation de l'impôt payable par un contribuable pour une année d'imposition donnée lorsque la nouvelle cotisation pour l'année donnée n'entraîne aucun changement à l'impôt net payable pour l'année et consiste seulement à substituer, par exemple, une perte subie au cours d'une année d'imposition ultérieure, réclamée en vertu des alinéas 111(1)a) et 152(6)c) L.I.R. ainsi que du sous-alinéa 152(4)b)(i) L.I.R., à un crédit d'impôt originellement réclamé dans l'année donnée, comme il semble être le cas dans votre exemple.

Interest and Loss Carryback

Subsection 161(7) of the ITA is relevant to the calculation of interest. It provides that, among other things, for loss carrybacks, the carryback is taken into account in the calculation of interest generally only from the date on which the carryback was requested.

The taxpayer may not have any income tax payable in the year to which the loss is carried back (hereinafter the "initial year"). For instance, a taxpayer may have claimed a foreign tax credit that reduces the tax payable to zero. A loss is then incurred in a subsequent year. That loss is carried back to the "initial year". The carryback is also made in the foreign jurisdiction, such that the taxpayer no longer has foreign tax and is no longer entitled to the foreign tax credit. In this case, subsection 161(7) of the ITA results in interest being calculated even though, in reality, the taxpayer never had an amount due in income tax in the "initial year", either because a foreign tax credit was available or because the loss was carried back.

Does the CRA agree with this interpretation? If so, could this situation be viewed favourably for fairness consideration?

CRA Response

We are of the opinion that, technically, your interpretation of subsections 161(1) and (7) of the ITA is correct in the example given.

However, the CRA has long had the administrative practice of not charging interest under subsection 161(1) of the ITA where there is a reassessment of income tax payable by a taxpayer in a particular taxation year and where the reassessment for that year results in no change in net tax payable for the year and consists only, for example, of substituting a loss incurred in a subsequent taxation year, claimed under paragraphs 111(1)(a) and 152(6)(c) of the ITA and subparagraph 152(4)(b)(i) of the ITA, for a tax credit originally claimed in the particular taxation year, as would seem to be the case in your example.
