Question 1
Assurance contre les maladies graves
Une société privée sous contrôle canadien est titulaire d'une police d'assurance contre les maladies graves pour assurer l'actionnaire unique contre les maladies graves.
Situation 1 : L'actionnaire est bénéficiaire de la prestation.
Situation 2 : La prestation est payable au titulaire.
Questions :
Pour chacune des situations :
1. Est-ce que les primes versées par la société sont déductibles?
2. Est-ce que le paiement des primes constitue un avantage imposable pour l'actionnaire?
3. Est-ce que la prestation reçue sera imposable?
Réponse de l'ADRC
Afin d'établir les conséquences fiscales d'une police d'assurance contre les maladies graves, il faut déterminer si la police est une police d'assurance contre la maladie ou les accidents ou une police d'assurance-vie sujette aux articles 148 et 12.2 L.I.R.
Le paragraphe 138(12) définit une police d'assurance-vie aux fins L.I.R. Toutefois, cette définition n'est pas exhaustive. L'expression "assurance contre la maladie ou les accidents" n'est pas définie dans L.I.R. Par conséquent, on doit s'en remettre au sens courant tel qu'employé dans l'industrie. À cet égard, la loi sur les assurances provinciale en vertu de laquelle la police est régie sera pertinente.
Lorsqu'une police est souscrite au Québec par des personnes qui y résident, la police est assujettie aux exigences de la Loi sur les assurances du Québec et du Code civil du Québec (C.c.Q.).
Aux fins de la présente réponse, nous présumerons que la police est assujettie aux exigences de la Loi sur les assurances du Québec et du C.c.Q. et que le contrat d'assurance contre les maladies graves prévoit exclusivement une prestation dans le cas des maladies graves et qu'il s'agit d'un contrat d'assurance contre la maladie.
Dans les situations décrites ci-dessus, nous sommes d'avis que les primes versées par une société en vertu d'un contrat d'assurance contre les maladies graves dont elle est titulaire ne sont pas déductibles dans le calcul de son revenu en vertu des alinéas 18(1)a) et/ou 18(1)b) L.I.R.
Sous réserve de certaines exceptions, le paragraphe 15(1) L.I.R. prévoit que la valeur de l'avantage qu'une société confère à un actionnaire au cours d'une année d'imposition est incluse dans le calcul de son revenu pour l'année. Ce paragraphe ne prévoit pas d'exception pour les avantages résultant de primes versées en vertu d'une police d'assurance contre les maladies graves.
Par conséquent, lorsqu'une société est titulaire d'une police d'assurance contre les maladies graves et que la prestation lui est payable, nous sommes d'avis que le paiement des primes par la société n'entraînerait pas un avantage conféré à un actionnaire imposable en vertu du paragraphe 15(1) L.I.R. Toutefois, si l'actionnaire est le bénéficiaire en vertu de la police, le paiement des primes constituera un avantage pour lequel l'actionnaire devra inclure le montant dudit avantage dans le calcul de son revenu en vertu du paragraphe 15(1) L.I.R.
Étant donné que le gain sur la disposition d'une police d'assurance est exclu de la définition de gain en capital en vertu du sous-alinéa 39(1)a)(iii) L.I.R., les prestations qui seront reçues par l'actionnaire ou la société en vertu d'un contrat d'assurance contre les maladies graves ne seront pas imposables à titre de gain en capital. De plus, les dispositions de l'article 148 L.I.R. ne sont pas applicables à un contrat d'assurance contre la maladie ou les accidents qui n'est pas un contrat d'assurance sur la vie et la Loi ne contient aucune disposition précise prévoyant l'inclusion de telles prestations dans un tel cas.
