Dans la situation exposée, il n'y a pas d'argent emprunté utilisé à une fin admissible pour les fins du sous-alinéa 20(1)c)(i) L.I.R., une fois que le bien est vendu.

Paragraphe 18(9.1) L.I.R. - Pénalité pour réduction du taux d'intérêt

Une société détient un immeuble faisant l'objet d'un emprunt hypothécaire, dans le cadre d'une activité dont elle tire un revenu de bien. Afin de bénéficier des taux d'intérêt moindres qui prévalent actuellement sur le marché, une pénalité est versée à l'institution financière en contrepartie de la réduction du taux d'intérêt payable sur l'emprunt. L'année suivante la société vend l'immeuble et l'acheteur prend en charge l'emprunt hypothécaire.

Le paragraphe 18(9.1) L.I.R. détermine le montant de la pénalité pouvant être déduit annuellement et qui ne peut excéder le montant qui aurait normalement été payé à titre d'intérêts n'eût été de la modification des termes de l'emprunt. En vertu de ce paragraphe, le paiement est réputé être fait à titre d'intérêts sur la créance.

Puisque le bien a été vendu, il semble que la déduction en vertu de l'alinéa 20(1)c) L.I.R. ne soit plus permise, puisque la société ne possède plus le bien financé par l'emprunt hypothécaire.

L'ADRC peut-elle préciser si dans la situation décrite ci-dessus, le paiement de la pénalité pour réduire le taux d'intérêt de l'emprunt hypothécaire, continuera à être déductible pour le contribuable dans le calcul de son revenu en vertu du paragraphe 18(9.1) et de l'alinéa 20(1)c) L.I.R.?

Réponse de l'ADRC

Le paragraphe 18(9.1) L.I.R. s'applique, entre autres, lorsqu'un contribuable fait un paiement à un moment donné, dans le cadre d'une activité dont il tire un revenu d'un bien, relativement à de l'argent emprunté et le paiement a été fait en vue de réduire le taux d'intérêt payable sur la créance. Pour être visée par ce paragraphe, la pénalité doit répondre à certaines conditions qui y sont stipulées et ne doit pas en être exclue par ailleurs.

Le paiement qui se rapporte aux intérêts qui, sans cette réduction, auraient été payés ou payables pour une année d'imposition se terminant après ce moment, est réputé en vertu de l'alinéa 18(9.1)a) L.I.R. être fait par le contribuable au moment donné à titre d'intérêts sur l'argent emprunté. Dans le cas d'un paiement fait en vue de réduire le taux d'intérêt sur un emprunt, le sous-alinéa 18(9.1)b)(i) L.I.R. répute le paiement, attribuable à une année d'imposition se terminant après le moment donné, avoir été payé ou payable au cours de l'année en question à titre d'intérêts en conformité avec une obligation légale de payer des intérêts sur l'argent emprunté pour les fins du calcul du revenu du bien en cause.

Pourvu que les autres exigences de l'alinéa 20(1)c) L.I.R. soient satisfaites, le paiement visé par l'alinéa 18(9.1)b) L.I.R. sera déductible dans le calcul du revenu que le contribuable tire du bien pour chaque année d'imposition pour laquelle le taux d'intérêt a été réduit. À cette fin, nous sommes d'avis qu'il faut établir pour chaque année d'imposition que l'argent emprunté est utilisé à des fins admissibles, c'est-à-dire en vue de tirer un revenu du bien.

Dans la situation décrite ci-dessus, nous sommes d'avis qu'il n'y a pas d'argent emprunté utilisé pour des fins admissibles, après les transactions en cause, puisqu'il n'y a plus de source de revenu. De plus, nous sommes d'avis que le sous-alinéa 18(9.1)b)(i) L.I.R. n'est pas applicable pour les années d'imposition subséquentes parce que le bien en question a été disposé.

Subsection 18(9.1) of the ITA-Penalty for interest rate reduction

A corporation owns real property subject to a mortgage loan with respect to an activity from which it earns property income. To benefit from interest rates that are lower than the prevailing market rates, a penalty is paid to the financial institution in consideration of a reduced interest rate payable on the loan. The following year, the corporation sells the real property and the purchaser takes over the mortgage loan.

Subsection 18(9.1) of the ITA determines the amount of the penalty that can be deducted annually and that cannot exceed the amount that would normally have been paid as interest if not for the amendment to the terms of the loan. Under this subsection, the payment is deemed to have been made as an interest payment on the debt obligation.

Given that the property has been sold, it seems that the deduction under paragraph 20(1)(c) of the ITA is no longer allowed because the corporation no longer owns the property financed by the mortgage loan.

Could the CCRA specify whether, in the situation described above, payment of the penalty for reducing the interest rate on the mortgage loan would continue to be deductible for the taxpayer in the computation of his income under subsection 18(9.1) and paragraph 20(1)(c) of the ITA?

The CCRA's response

Subsection 18(9.1) of the ITA is applicable where a taxpayer makes a payment in relation to money borrowed, at a given time, with respect to an activity from which he is earning property income, and the payment is made with a view to reducing the interest rate payable on the debt obligation. To be included in this paragraph, the penalty must meet certain stipulated conditions and must not be otherwise excluded.

The interest payment that, without this reduction, would have been paid or payable for a taxation year ending after this time, is deemed to be made, under paragraph 18(9.1)(e) of the ITA, by the taxpayer at the given time as interest on the funds borrowed. Where a payment is made with a view to reducing the interest rate on a loan, under subparagraph 18(9.1)(f)(i) of the ITA, the payment, which can be allocated to a taxation year ending after the given time, is deemed to have been paid or payable during the year at issue as interest in accordance with a legal obligation to pay interest on the money borrowed for the purpose of computing income from the property at issue.

As long as the other requirements of paragraph 20(1)(c) of the ITA have been met, the payment described in paragraph 18(9.1)(f) of the ITA is deductible in the computation of the income that the taxpayer earns from the property for each taxation year for which the interest rate was reduced. To this end, it is our opinion that it is necessary to establish that the money borrowed is used for eligible purposes, namely, to earn property income, for each taxation year.

In the situation described above, it is our opinion that no money borrowed used for eligible purposes after the transactions at issue because there is no longer a source of income. Moreover, it is our opinion that subparagraph 18(9.1)(f)(i) of the ITA is not applicable for subsequent taxation years because the property at issue has been disposed of.
