Dear Sir,

Subject: Moving expenses - Section 62 of the Income Tax Act

This is in response to your fax of March 19, 2003 in which you requested our opinion on the above subject. We apologize for the delay in responding to this request.

Facts

You presented us with the situation of an employee who was working for Aco. The employee has accepted a new job with Bco. Bco's place of business is located on a different floor of the same building where Aco is located and where the employee reported to work at his previous employment. Due to the demands of this new employment with Bco, the employee will have to move at least 40 kilometres closer to his work location, due in part to the additional hours of work that will be required.

Question

You asked us whether the employee's moving expenses can be deducted pursuant to section 62 of the Income Tax Act (the "Act"). You are of the opinion that all the conditions for the application of section 62 are satisfied and that the employee could deduct his moving expenses within the limits allowed.

Our Comments

The situation described in your request appears to us to be an actual situation and, as stated in paragraph 22 of Information Circular 70-6R5 of May 17, 2002, the Directorate does not generally give a written opinion on proposed transactions otherwise than by way of an advance ruling. Furthermore, the determination of whether a completed transaction has received the appropriate tax treatment is a matter for the Tax Services Offices. However, we offer the following general comments. Our comments, however, may not apply in full to your particular situation.

In order for a taxpayer to deduct moving expenses pursuant to subsection 62(1), one of the requirements is that the expenses be incurred in respect of an "eligible relocation" as defined in subsection 248(1). A relocation of a taxpayer is an "eligible relocation" if certain conditions are satisfied. Among other things, the relocation must be "... to enable the taxpayer ... to be employed at a location in Canada". As stated in paragraph 15 of Interpretation Bulletin IT-178R3, Moving Expenses, eligible moving expenses are deductible only when the reason for the residential move is, inter alia, to begin employment or business at the new location. In determining whether or not a move is made for employment purposes, the circumstances must be considered. In addition, the amount deductible pursuant to section 62 must be reasonable in the circumstances and must have been paid by the taxpayer as or on account of moving expenses incurred in the course of moving from the taxpayer’s former to the new place of residence.

Based on the information you have provided in this situation, it is not possible for us to determine whether the employee's move meets the definition of a "eligible relocation". In order to reach a definitive conclusion, we would have to review the reasons why the taxpayer was forced to relocate as part of an audit to determine clearly whether the move was made to enable the employee to take up employment at the new location or whether the move was made for personal reasons.

These comments are not advance income tax rulings and are not binding on the Canada Customs and Revenue Agency in any particular case.

Objet: Frais de déménagement - Article 62 de la Loi de l'impôt sur le revenu

La présente est en réponse à votre fac-similé du 19 mars 2003 dans laquelle vous demandez notre opinion concernant l'objet mentionné ci-dessus. Nous nous excusons du délai requis pour répondre à cette demande.

Faits

Vous nous présentez la situation d'un employé qui occupait un poste au sein de la Société A. Ce dernier a accepté un nouvel emploi au sein de la Société B. La place d'affaires de Société B est située sur un étage différent du même édifice où Société A est située et où l'employé se rapportait au travail pour son ancien emploi. En raison des exigences inhérentes à ce nouvel emploi avec la Société B, l'employé devra se rapprocher de son lieu de travail d'au moins 40 kilomètres, en raison notamment des heures de travail supplémentaires qui devront être accomplies.

Question

Vous nous demandez si les dépenses relatives au déménagement de l'employé pourront être déduites en vertu de l'article 62 de la Loi de l'impôt sur le revenu (ci-après la " Loi "). Vous êtes d'avis que toutes les conditions d'application de l'article 62 de la Loi sont rencontrées et que l'employé pourrait déduire ses dépenses de déménagement dans les limites permises.

Nos commentaires

La situation décrite dans votre demande nous apparaît être une situation réelle et, tel que mentionné au paragraphe 22 de la Circulaire d'information 70-6R5 du 17 mai 2002, la Direction ne donne généralement pas d'opinion écrite concernant des opérations projetées autrement que par voie de décision anticipée. Par ailleurs, lorsqu'il s'agit de déterminer si une transaction complétée a reçu le traitement fiscal adéquat, la compétence en revient aux bureaux des services fiscaux. Toutefois, nous vous offrons les commentaires généraux suivants. Cependant, nos commentaires pourraient ne pas s'appliquer intégralement à votre situation particulière.

Pour qu'un contribuable puisse déduire des frais de déménagement en vertu du paragraphe 62(1) de la Loi, il faut, entre autres, que ces derniers aient été engagés relativement à une " réinstallation admissible ", telle que cette expression est définie au paragraphe 248(1) de la Loi. Une réinstallation d'un contribuable est une " réinstallation admissible " si certaines conditions sont rencontrées. Entre autres, cette réinstallation doit être " ... effectuée afin de permettre au contribuable ... d'occuper un emploi à un endroit au Canada ". Tel que précisé au paragraphe 15 du Bulletin d'interprétation IT-178R3, Frais de déménagement, les frais de déménagement ne sont déductibles que lorsque le contribuable change de lieu de résidence pour, entre autres, occuper un emploi. Pour établir si un déménagement est effectué ou non pour occuper un emploi, il faut tenir compte des circonstances. De plus, le montant déductible en vertu de l'article 62 de la Loi doit être raisonnable dans les circonstances et doit avoir été payé par le contribuable à titre ou à cause de frais de déménagement engagés au cours du déménagement entre son ancien et son nouveau lieu de résidence.

D'après l'information que vous nous avez fournie dans la présente situation, il ne nous est pas possible de déterminer si le déménagement de l'employé rencontre la définition d'une " réinstallation admissible ". Pour arriver à une conclusion de façon définitive, il nous faudrait, dans le cadre d'une vérification, passer en revue les raisons pour lesquelles le contribuable s'est vu contraint de déménager afin de déterminer de façon claire si le déménagement a eu lieu afin de permettre à l'employé d'occuper un emploi à un nouveau lieu de travail ou si le déménagement a plutôt eu lieu pour des raisons personnelles.

Ces commentaires ne constituent pas des décisions anticipées en matière d'impôt sur le revenu et ne lient pas l'Agence des douanes et du revenu du Canada à l'égard d'un cas d'espèce donné.
