Objet : Indemnité versée à un REÉR
La présente fait suite à votre lettre du 20 décembre 2001 dans laquelle vous demandez notre interprétation concernant les conséquences fiscales dans le cas où un courtier verse une indemnité à une fiducie régie par un REÉR pour compenser les pertes qu'elle a subies par suite de la gestion du courtier. Vous nous indiquez que l'indemnité pourrait être versée à la fiducie qui a subi le préjudice ou à une autre fiducie régie par un REÉR.
Tel qu'il est mentionné au paragraphe 22 de la Circulaire d'information 70-6R4 du 29 janvier 2001, nous avons comme pratique de ne pas émettre d'opinion écrite concernant des transactions projetées autrement que par voie de décisions anticipées. Par ailleurs, lorsqu'il s'agit de déterminer si une transaction complétée a reçu le traitement fiscal adéquat, la décision en revient d'abord à nos bureaux des services fiscaux à la suite de l'examen de tous les faits et documents, ce qui est généralement effectué dans le cadre d'une mission de vérification. Nous pouvons toutefois vous offrir les commentaires généraux suivants qui, nous l'espérons, vous seront utiles. Ces commentaires pourraient cependant, dans certaines circonstances, ne pas s'appliquer à votre situation particulière.
La position de l'agence quant au versement de dommages et d'intérêts pour des pertes subies par un REÉR est exposée dans la décision anticipée en matière d'impôt sur le revenu ATR-24. Pour les fins de la Loi de l'impôt sur le revenu (la Loi), une fiducie régie par un REÉR est une personne quant aux biens de la fiducie. De façon générale, les indemnités pour la perte que la fiducie a subie devraient être versées directement à cette fiducie. Dans un tel cas, la somme versée ne constituerait pas une prime au sens du paragraphe 146(1) de la Loi et ne serait pas incluse dans le revenu du rentier.
