Re: Technical Interpretation Request: Private Health Services Plan ("PHSP")
This is in reply to your letter wherein you asked whether the two medical plans, submitted with your letter, would be recognized as PHSP's.
We cannot confirm the tax implications of particular transactions unless the transactions are proposed and are the subject matter of an advance income tax ruling request submitted in the manner set out in Information Circular 70-6R4 (enclosed). Whether or not an arrangement qualifies as a PHSP can only be confirmed by way of an advance income tax ruling request.
We have also enclosed a copy of Interpretation Bulletin IT-339R2, "Meaning of Private Health Services Plan" for your information.
