Position Adoptée: Oui, un tel choix peut être modifié lorsque le ou les fiduciaires peuvent établir qu'une erreur de bonne foi a été commise. Toutefois nous ne procéderons pas à l'émission d'une nouvelle cotisation visant à réduire le revenu du bénéficiaire lorsqu'un ajustement corrélatif de la déclaration de revenus de la fiducie ne peut être effectué parce que l'année d'imposition est prescrite.

Mme X est bénéficiaire du revenu d'une fiducie. En vertu des termes de l'acte de fiducie, le gain en capital imposable de la fiducie est réputé être du revenu.
En 19x1, la fiducie réalise un gain en capital imposable de 60 000 $. Selon les clauses de l'acte de fiducie, ce montant de 60 000 $ est réputé être " payable " en vertu du paragraphe 104(6) L.I.R. Le fiduciaire effectue un choix en vertu du paragraphe 104(13.1) L.I.R. afin d'imposer un montant de 30 000 $ au niveau de la fiducie.
En19x2, la fiducie réalise une perte en capital déductible de 40 000 $.
Suivant le principe établi par l'arrêt Lussier, est-il possible de modifier le choix effectué en vertu du paragraphe 104(13.1) L.I.R. en 19x1 afin de pouvoir reporter la totalité de la perte en capital déductible de 40 000 $ réalisée en 19x2 à l'année 19x1?
Réponse de l'ADRC
Le paragraphe 104(13.1) L.I.R. prévoit un mécanisme permettant à un fiduciaire de choisir que tout ou partie du revenu de la fiducie ayant été distribué à un bénéficiaire sera imposé entre les mains de la fiducie plutôt qu'entre celles du bénéficiaire à qui le revenu a été versé. Compte tenu que la L.I.R. ne prévoit pas la possibilité de modifier, annuler ou effectuer une telle attribution après la production de la déclaration de revenus de la fiducie, la position de l'ADRC était à l'effet qu'une telle attribution se devait d'être effectuée à même la déclaration de revenus de la fiducie.
Cependant, nous acceptons la décision rendue par la Cour canadienne de l'impôt dans l'affaire Lussier c. La Reine, 99 DTC 1029, et sommes par conséquent d'avis qu'une telle attribution peut être modifiée, annulée ou effectuée après la production de la déclaration de revenus de la fiducie lorsque le fiduciaire peut démontrer qu'une erreur de bonne foi a été commise. Le fait qu'une erreur de bonne foi avait été commise constitue un élément important de la décision de la Cour canadienne de l'impôt dans l'affaire Lussier, précitée. Toutefois, nous ne procéderons pas à l'émission de nouvelles cotisations visant à réduire le revenu du bénéficiaire lorsque la déclaration de revenus de la fiducie ne peut être ajustée de façon corrélative pour des raisons de prescription.
À titre d'exemple, il pourrait s'agir d'une erreur commise de bonne foi lorsque le contribuable ignorait qu'une telle attribution pouvait être effectuée ou encore lorsqu'une attribution entraîne des conséquences fiscales non-voulues et qu'il existe des éléments de preuve démontrant que le contribuable a pris des mesures raisonnables afin de se conformer à la L.I.R. et a tenté de remédier à la situation aussitôt que possible. La planification fiscale rétroactive ne sera cependant pas acceptée. Ainsi, une attribution en vertu du paragraphe 104(13.1) L.I.R. ne pourra généralement pas être modifiée, annulée ou effectuée après la production de la déclaration de revenus de la fiducie lorsque cette modification, cette annulation ou cette attribution tardive est motivée par des événements survenus après la production de la déclaration de revenus de la fiducie. Par conséquent, en regard de la situation hypothétique décrite ci-haut, il ne serait pas possible de modifier le choix effectué en vertu du paragraphe 104(13.1) L.I.R. en 19x1 afin de pouvoir reporter la totalité de la perte en capital déductible de 40 000 $ réalisée en 19x2 à l'année 19x1.

Application of subsection 104(13.1) of the ITA
Ms. X is the income beneficiary of a trust. Pursuant to the trust indenture, any taxable capital gain of the trust is deemed to be income.
In 19x1, the trust realizes a taxable capital gain of $60,000. According to the provisions of the trust deed, this $60,000 is deemed to be "payable" pursuant to subsection 104(6) of the ITA. The trustee makes an election pursuant to subsection 104(13.1) of the ITA to make an amount of $30,000 taxable to the hands of the trust.
In 19x2, the trust realizes a deductible capital loss of $40,000.
Following the principle established in the Lussier case, is it possible to change the election made pursuant to subsection 104(13.1) of the ITA in 19x1 in order to carry back the total amount of the $40,000 deductible capital loss incurred in 19x2 to 19x1?
The CCRA's answer
Subsection 104(13.1) of the ITA prescribes a mechanism allowing a trust to elect whether all or part of the income of the trust distributed to a beneficiary will be taxed in the hands of the trust rather than in the hands of the beneficiary to whom the income was paid. Since the ITA does not provide for the possibility of changing, cancelling, or making such a designation after the trust files its income tax return, the CCRA's position was that such a designation had to be made on the trust's income tax return.
However, we accept the Tax Court of Canada's decision in Lussier v. The Queen, 99 DTC 1029, and, as a result, we believe that such a designation may be modified, cancelled, or made after the trust files its income tax return when the trustee can demonstrate that an honest mistake was made. The fact that an honest mistake was made was an important part of the Tax Court of Canada's decision in Lussier, above. However, we will not reassess to reduce the beneficiary's income in situations where a corresponding adjustment to the trust's income tax return cannot be made because the years are statute-barred.
An example of an honest mistake could include a situation where the taxpayer was not aware that such a designation could be made or when the designation results in unintended tax consequences and there is evidence that the taxpayer took reasonable steps to comply with the ITA and undertook remedial action as quickly as possible. Retroactive tax planning, however, will not be accepted. Hence, it will generally not be possible to modify or cancel a designation made under subsection 104(13.1) of the Act, or to make such a designation after the trust has filed its income tax return, where such modification, cancellation or late-filing is motivated by events which occurred after the income tax return of the trust was filed. As a result, with respect to the hypothetical situation submitted above, it would not be possible to modify the subsection 104(13.1) designation made in 1x91 in order to carry back the total amount of the $40,000 deductible capital loss incurred in 1x92 to 1x91.
