Dear XXXXXXXXXX:
Re: Disability Payments received from a former Employer -Your 1999 Income Tax Return
Further to our letter of June 26 and our conversation of July 4, I am writing to provide a clarification that you requested.
This will confirm our general view that it is possible for an employee to receive a workers' compensation payment from his or her employer that would be included in income under paragraph 56(1)(v) of the Income Tax Act. This is supported by the comments in paragraph 4 of interpretation bulletin IT-202R2. A copy of the bulletin is enclosed.
Yours truly,
Bryan Dath
