The
Court would like to note that, in contrast to what counsel for the respondent
seems to believe, the motion for an extension of time and the supporting
affidavit comply with Rule 82 of the Rules of Practice. The motion was submitted
by Mr. Danis, and the affidavit is that of Mr. Denis.

The
application for dismissal for failure to submit a requisition for hearing in a
timely manner is therefore dismissed, and the application for an extension of
time will be allowed. The application to have the hearing of the appeal
scheduled must be submitted within ten (10) days of this order.
