The
Attorney General of Quebec’s motion will be dismissed, because under section 57
of the Federal Courts Acts, R.S.C. 1985, c. F-7, she is entitled to
adduce evidence and make submissions to this Court “in respect of the
constitutional question” and, furthermore, under subsection 57(5), she is
deemed to be a party to the proceedings for the purpose of any appeal in
respect of the constitutional question.

Consequently,
the Attorney General of Quebec is entitled to participate in the appeal as of
right without necessarily obtaining leave of this Court.
[3]
In
the event the parties cannot agree on a schedule regarding the submission of
their respective records and their memoranda, they can ask the Court to
determine this issue.
