BETWEEN:
EDWIN PEARSON
Appellant
- and -
HER MAJESTY THE QUEEN
Respondent
Heard at Toronto, Ontario, on Wednesday, September 11, 2002.
Judgment delivered from the Bench at Toronto, Ontario, on Wednesday, September 11 , 2002.
REASONS FOR JUDGMENT OF THE COURT BY: LINDEN J.A.
[1] Despite the lengthy and technical argument of the appellant, we have not been persuaded that Justice Hansen erred in the exercise of her discretion pursuant to Rule 55. We are satisfied that she gave sufficient weight to all the relevant considerations in making the order dated June 21, 2001. We find no legal or factual errors that would warrant our intervention.
[2] In our view, her creative order, in light of the history and complexity of this case, will ensure that justice between the parties will ultimately be done.
[3] The appeal will be dismissed with costs.
