[1] On May 27, 1998, the Court dismissed, with costs, the Applicants's Application for Judicial Review. On April 30, 2003, the Respondent filed the bill of costs for assessment.
[2] By way of letter dated July 7, 2003, a timetable was set for the filing of Written submissions. The Applicant did not file submissions in the time allowed.
[3] Having reviewed the Written submissions of the Respondent and the record before me, and in the circumstances of this file, I hereby allow costs to the Respondent, inclusive of $200.00 costs for the assessment of these costs, in the amount of $2,971.83.
A certificate of assessment will issue in the amount of $2,971.83.
