REASONS RESPECTING SUBMISSIONS ON COSTS

[1]              Pursuant to paragraph 45 of my Reasons for Judgment, dated December 1, 2010, the parties were allowed 45 days to provide written submissions respecting the issue of costs.

[2]              In the Respondent’s letter to this Court dated January 17, 2011, it states:

…we highlight that the respondent was completely successful in the appeal, the global amount at issue was over $600,000, and there was over 1000 pages of evidence.

[3]              The Appellant has not filed any submissions with the Court and is now out of time to do so.

[4]              Having considered the Respondent’s submissions, the Respondent shall be awarded its costs of these appeals, together with its disbursements, in accordance with the tariff.
