Pursuant to paragraph
45 of my Reasons for Judgment, dated December 1, 2010, the parties were allowed
45 days to provide written submissions respecting the issue of costs.

In the Respondent’s
letter to this Court dated January 17, 2011, it states:
…we highlight that the respondent was completely successful in the
appeal, the global amount at issue was over $600,000, and there was over 1000
pages of evidence.

The Appellant has not
filed any submissions with the Court and is now out of time to do so.
[4]
Having considered the
Respondent’s submissions, the Respondent shall be awarded its costs of these
appeals, together with its disbursements, in accordance with the tariff.
