International Transfer Pricing

The arm's length principle is stated in paragraph 1 of Article 9 of the OECD Model Tax Convention: "Where... conditions are made or imposed between... two [non-arm's length] enterprises in their commercial or financial relations which differ from those which would be made between [arm's length] enterprises, then any profits which would, but for those conditions, have accrued to one of the enterprises, but, by reason of those conditions, have not so accrued, may be included in the profits of that enterprise and taxed accordingly. ... These rules: are generally found in Article IX of the relevant treaty; are often modelled after Article 9 of the OECD Model Tax Convention on Income and on Capital; and provide a framework in which adjustments to profits by one country's tax administration may be offset by a corresponding adjustment by the tax administration of another country. 216. ...
