JUDGMENT The appeal from the judgment of the Court of Appeal for Ontario, Number C68236, 2022 ONCA 229, dated March 21, 2022, was heard on April 17, 2023, and the Court on that day delivered the following judgment orally: Côté J. — We are all of the view to allow the appeal on the first ground relating to s. 11(b) of the Canadian Charter of Rights and Freedoms . This first ground is dispositive, so we decline to address the second. As the Crown conceded, in view of the s. 11(b) breach, a stay of proceedings is warranted. Reasons to follow shortly. We therefore allow the appeal, set aside the convictions and order a stay of proceedings. |

JUGEMENT L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C68236, 2022 ONCA 229, daté du 21 mars 2022, a été entendu le 17 avril 2023 et la Cour a prononcé oralement le même jour le jugement suivant : [traduction] La juge Côté — Nous sommes toutes et tous d’avis d’accueillir l’appel pour le premier moyen invoqué, celui relatif à l’al. 11b) de la Charte canadienne des droits et libertés . Comme ce premier moyen est déterminant, nous nous abstenons d’examiner le second. Ainsi que l’a concédé la Couronne, vu la violation de l’al. 11b), l’arrêt des procédures est justifié. Des motifs suivront sous peu. En conséquence, nous accueillons l’appel, écartons les déclarations de culpabilité et ordonnons l’arrêt des procédures. |
