We see no basis upon which we could interfere
with the judgment of the Federal Court which struck the Appellant’s statement
of claim in its entirety on the ground that it was plain and obvious that it
did not disclose a reasonable cause of action.

The appeal shall therefore be dismissed but, in
the circumstances, without costs.
