REASONS FOR JUDGMENT OF THE COURT

We have reached the conclusion that no decision
has been made by the Canada Employment Insurance Commission (the Commission) with
respect to the applicant’s request for a write-off pursuant to paragraph 56(1)(f)
of the Employment Insurance Regulations, SOR/96-332 (the Regulations).
[2]
Because the respondent has confirmed that the
Commission remains willing to consider whether a write-off is justified under
that provision, the present appeal is premature. We strongly urge the applicant
to provide the Commission with the requested information so that a potential
end can be brought to his quest for relief.
[3]
Should the Commission not accede to the
applicant’s request, he retains the right to contest that decision and
eventually advance all the arguments which were placed before us in the context
of the present application, including those relating to subsection 56(2) of the
Regulations.
[4]
The application is accordingly dismissed, the
parties assuming their respective costs.
