REASONS FOR JUDGMENT OF THE COURT
(Delivered from the Bench at Ottawa, Ontario
on May 21, 2002.)
ISAAC J.A.:
[1] The appellants appeal against ten orders of Denault J, dated 5 October, 2000, and two orders of Blanchard J dated 30 March, 2001, and 9 May, 2001, respectively.
[2] The orders of Denault J were made first on motions for orders pursuant to Rule 208, that this Court had no jurisdiction to entertain the causes of action raised in the statements of claim, and second, for orders pursuant to Rule 221 striking out the statements of claim and dismissing the actions as against them on the ground that they disclosed no reasonable causes of action.
[3] For his part, Blanchard J heard a motion by the Canadian Judicial Council for an order, pursuant to Rule 221, striking out the statement of claim and dismissing the action against it. Of his own motion, the learned motions Judge raised the issue of jurisdiction of the Court to entertain the claim which he decided adversely to the appellants.
[4] On 9 May, 2001, Blanchard J dismissed the appellants' motion dated 27 February, 2001, but he granted them an extension of time to respond to a motion brought by the Corporation of the City of Ottawa. He also dismissed the appellants' request that their motion dated 9 November, 2000 be heard before that of the Corporation of the City of Ottawa or alternatively, that both motions be deferred until the final appeal had been heard.
[5] After hearing submissions from each of the appellants, at great length, we are not persuaded that either of the learned Judges made any error in law. Furthermore, we are satisfied that in each case they both took into account all relevant considerations in exercising their discretion pursuant to Rule 221 to strike out the statements of claim.
[6] Accordingly, the appeals will be dismissed with costs to the respondents who appeared at the hearing of these appeals.
