This is an
application for judicial review brought by Mr. Malenfant against an
Umpire’s decision (CUB 78828) dismissing his appeal from a majority decision of
a Board of Referees. The result of these earlier decisions is that the
applicant is not entitled to receive employment insurance benefits, having lost
his employment by reason of his own misconduct.

We have not been
persuaded that the Umpire committed any error of law or any other error that
warrants the intervention of this Court. Accordingly, the application for
judicial review is dismissed without costs, the respondent having waived them.
