Lamer C.J. -- In the appeal R. v. Sharma, on consent of both parties, and given the fact that the Ontario Court of Appeal was without jurisdiction to entertain the Crown appeal to that court, we allow the appeal, quash the order of the Court of Appeal, and restore the stay entered by the trial judge.
