APPEAL from a judgment of the Federal Court of Appeal dismissing an application to review and set aside a decision of the Public Service Appeal Board allowing an appeal against the proposed appointment of the appellant to a position in the Public Service. Appeal allowed.

MARTLAND J.—The appeal is allowed, the judgment of the Federal Court of Appeal and the decision of the Public Service Commission Appeal Board insofar as it relates to the appellant are set aside and the matter is referred back to the Public Service Commission Appeal Board for a new hearing. It is directed that the appellant be given notice of such hearing and be given an opportunity to be heard.
The appellant is entitled to costs.
