Date: 20081114
Docket: T-2116-06
Citation: 2008 FC 1273
Between:
CHRISTIAN A. MEYER
Plaintiff
and
HER MAJESTY THE
QUEEN
Defendant
ASSESSMENT OF
COSTS –REASONS
DIANE PERRIER, ASSESSMENT OFFICER
[1]
On March 6, 2007, the Court granted Defendant’s motion for an order striking
out the Plaintiff’s statement of claim with costs. On May 17, 2007, the Defendant
filed its bills of costs and asked that it be assessed without the personal
appearance of the parties. As of this date, Mr. Christian A. Meyer has not
filed any representations. I am now ready to proceed with the assessment of
costs based on the documentation on file.
[2]
The Defendant’s fees are allowed in the amount of $960.00. The Defendant
requested 7 units for item 5 for the preparation and filing of a contested
motion, including materials and responses and 6 units for item 26 – assessment
of costs. I have reduced item 5 to 6 units in view of the complexity of the
motion before the Court. I have also reduced item 26 to 2 units because the
assessment of costs was not contested and it does not appear too complex.
[3]
All the disbursements incurred in this matter are allowed as follows: $182.50
for the reproduction of the Defendant’ Motion Record and $5.30 for the service
of Defendant’s Motion Record which appears reasonable and is proven by the
affidavit of Suzanne Dussault Harvey.
[4]
In view of the preceding, the costs of the Defendant are assessed in the
amount of $1,147.80. A certificate will be issued for this amount.
