[1]
On
May 24, 2006, the Court ordered that default judgment be rendered against the Defendant
in the amount of $6,924.93, plus pre-judgment interest in the amount of $490.52
with costs to be assessed, payable by the Defendant to the Plaintiff.
[2] On June 4, 2008, Plaintiff filed
its bill of costs requesting that the taxation be done in writing. On September
25, 2008, letters were sent to the parties requesting written representations. As
of this date, no submissions have been filed. I am now prepared to proceed with
the assessment.
[3] The Plaintiff requested the
following assessable services: item 1 – preparation and filing of the statement
of claim (5 units), item 4 – preparation and filing of an uncontested motion (4
units) and item 26 – assessment of costs (5 units). Items 1 and 4 are allowed
as claimed. I have reduced item 26 from 5 to 2 units for the assessment of
costs as this proceeding was not contested. The total assessable services are
allowed in the amount of $1,320.00.
[4] The disbursements incurred in
this matter are allowed in the amount of $50.00 for the filing of the statement
of claim.
[5] The Plaintiff’s bill of costs
presented at $1,730.00 is accordingly assessed and allowed in the amount of
$1,370.00. A certificate of taxation will be issued in that amount.
