This is an application for an interim injunction by two members of the Madawaska Maliseet First Nation, Sharon Wallace-Beaulieu and Jean-Guy Cimon.
On January 29, 1999 elections were held by the Madawaska Maliseet First Nation to elect a Chief and two Councillors. Mr. Cimon was elected Chief and Ms. Beaulieu was elected as one of the two Councillors.
After the said election, an appeal was filed with the Minister of Indian Affairs and Northern Development.

As a result of the said appeal, on October 21, 1999, it was determined "that there were contraventions of subsections 75(2) and 77(1) of the Indian Act that affected the results of the election" and the election of the Chief and the two Councillors was set aside.
New elections for these positions are now being called.
The present applicants' are asking the Court for:
"En vertu de l'article 18.2 de la Loi sur la Cour Fédérale, chapitre F-7, L.R.C.:
a) une injonction intérimaire visant à empêcher que des élections en vue d'élire un nouveau Conseil de Bande pour la Madawaska Maliseet First Nation soit tenues avant que la Cour Fédérale ait rendu une décision sur la teneur d'un décret conseil C.P. 19991886, daté du 21 octobre 1999, à l'effet que les élections du Conseil de Bande de la Madawaska Maliseet First Nation tenue le 29 janvier 1999 n'étaient pas valides;
b) une déclaration à l'effet que le Conseil de Bande élu aux élections du 29 janvier 1999 restera en fonction jusqu'à ce que la Cour Fédérale ait déterminé la validité du décret en conseil C.P. 19991886, en date du 21 octobre 1999. "
After hearing the parties by telephone conference on October 29, 1999, I dismissed the application because I was satisfied that the applicants failed to show any irreparable harm if new elections took place.

Both the applicants can stand for election once again. If I issued an injunction and permitted a judicial review of the Respondent's decision of October 21, 1999, it could well take 6 or more months for the hearing. Both applicants were elected for a period of two years. By the time of the hearing the applicants would have almost completed their terms.
If the Judicial Review was denied, the First Nation would have been led by an illegal Chief & Council for almost the full term of two years.
I am satisfied the First Nation would suffer irreparable harm if I did not allow the new election to proceed.
