[1] In spite of the argument on behalf of counsel for the applicant, I am unable to conclude that the Board was clearly wrong in its assessment of conditions in Sri Lanka as they pertain to the applicant. I am not satisfied the panel ignored the evidence of conditions at the time of the applicant's hearing. I accept that conditions in Sri Lanka are difficult but the panel's duty is to determine if there is a well-founded fear of persecution by the applicant. The panel found there was not and in doing so, I cannot say that it was clearly wrong. This is not a case for intervention by the Court. The judicial review must be dismissed.
