[1] The Defendants seek a better affidavit of documents in connection with the Plaintiffs' claim for damages to its goodwill. The Plaintiffs have filed various affidavits which were used in a successful motion for summary judgment which mention dollars worth of sales and dollars spent on advertising. But the Plaintiffs fail to list the documents which enabled the affiants to swear to their various quantitative statements.
[2] There are cases as the Plaintiffs have submitted where damages have been awarded for the diminution of goodwill when there are no comparative figures to show such diminution. However, in this case the Plaintiffs have stated they intend to rely on the affidavits which show quantities in fairly precise amounts. So precise that I question whether they come from someone's memory. If the affidavits are relevant, so may be the documents showing the quantities sworn to by the affiants. I should point out that the listing of the affidavits does not prove the relevance of them or their content. But, the affidavit filed by the Plaintiffs in connection with this motion indicates they will rely on the affidavits.
ORDER
1. The Plaintiffs shall have 15 days to list in an affidavit of documents those documents which support the figures sworn to in the affidavit filed and to produce the same. If they are audited figures, nothing behind the audited figures needs to be produced at this stage.
2. Costs of the preparation of the documents for this motion to the Defendants in any event of the reference.
