[1] This assessment of costs is
pursuant to the order made by Mr. Richard Morneau, Prothonotary, on
April 2, 2004, ordering the respondent to pay the applicant the sum
of $10,809.00 with interest at the legal rate from the putting in default dated
July 30, 2003, plus the additional indemnity provided in
article 1619 of the Civil Code of Québec, with costs against the
respondent.
[2] Counsel for the applicant filed
his bill of costs on July 5, 2004, accompanied by a request for a
decision without personal appearance of the parties.
[3] On August 31, 2004, a copy of
the applicant’s bill of costs was sent to the respondent so it could present
its representations in writing, which it has still not done to this date. In
view of the foregoing, I am prepared to assess the costs in favour of the
applicant.
[4] The fees requested are allowed
with the exception of the request under item 26 for the assessment of
costs. Since the assessment of costs was not contested, 2 units are
allowed.
[5] The disbursements are allowed
as requested.
[6] The costs of the applicant are
therefore assessed and allowed in the amount of $2,097.91. A certificate shall
issue for that amount.
