This is a written assessment of the bill of
costs due to the defendant following the order dated August 29, 2005,
dismissing the appeal of the decision dated June 30, 2005, and the order dated
December 15, 2005, recognizing the discontinuance. At the plaintiff’s
request, we issued a schedule for the filing of written submissions. As no
response has been received to date, I am prepared to assess the bill of costs
as submitted.

The fees are set in the amount of $1,575.84 for
the following items of Tariff B: 5 (10 units), 6 (2 units x 0.066 hour), 25 (1
unit) and 26 (2 units). I reduced the number of units requested for the
assessment of costs to two because it was a simple procedure that was not
contested.

The disbursements incurred in this matter in the
amount of $223.70 are allowed as claimed, as they were established by
affidavit.
[4]
For these reasons, the defendant’s costs are
assessed and allowed in the amount of $1,799.54. A certificate is issued for
that amount.
