JUGEMENT
L’appel interjeté contre l’arrêt de la Cour d’appel du Québec (Montréal), numéro 500-10-700053-232, 2025 QCCA 347, daté du 24 mars 2025, a été entendu le 3 décembre 2025 et la Cour a prononcé oralement le même jour le jugement suivant :
Le juge en chef — Une majorité des juges de notre Cour est d’avis de rejeter le pourvoi, essentiellement pour les motifs des juges majoritaires de la Cour d’appel portant sur l’insuffisance des motifs du jugement de première instance.
La juge Côté, pour sa part, aurait accueilli le pourvoi pour les motifs du juge dissident.

JUDGMENT
The appeal from the judgment of the Court of Appeal of Quebec (Montréal), Number 500-10-700053-232, 2025 QCCA 347, dated March 24, 2025, was heard on December 3, 2025, and the Court on that day delivered the following judgment orally:

The Chief Justice — A majority of this Court would dismiss the appeal, substantially for the reasons of the majority of the Court of Appeal concerning the inadequacy of the trial judge’s reasons.
Justice Côté, for her part, would have allowed the appeal for the reasons given by the dissenting judge.
